I'd get your complaint into the FOS ASAP. They are currently operating with severe backlogs so expect well over 6 months to review your case.
I went stright to the FOS as no one would take responsibility, I'm happy for Trent Services to pay the £500 case fee even though my refund would be £300. No doubt there will be some arguements about who is responsible.
I the adjudicator doesnt find in your favour remember to refer it to an Ombudsman.
I'm hoping an overall decision will be made before it gets to that stage0 -

I've just spoken to Trent Services who now adminster my policy, Assurant used to underwrite the policy, but that has moved to Alpha Insurance, Trent services say because it changed insurer its effectively a new policy and therefore no refunds, although the letter back in April last year said no terms or conditions have been changed!!!:(
This might go a long way to explain something that has been bugging me
I made a claim for 10 months last year, returned to work, only to be laid off again 5.5 months down the line.
I thought I was !!!!!!ed as Assurant terms and conditions state that if you return to work for 3 months or less we will treat as a continuous claim. anything more between 3-6 months they will pay nothing.
Thought I chance my arm and send in a new claim form and low and behold they have accepted it and it's under a completely different claim number then my previous claim. So it can't be continuous and they stated waiting periods etc.
Just to be on the safe side I have investigated and taken legal advice on the 3-6 month term and this is boarding on illegal as well as unfair and I was going to report to the FSA under the unfair terms act if they refused my claim. If you look at the cancellation conditions as well , they are definitely on very dodgy ground with the wording in them. So not all bad.
If also been having it out Cardif Pinnicle as they sent me a letter advising the they had extend the terms and conditions from their MPI plans to my secured loan protection. Upon trying to make another claim they said I couldn't as I hadn't been back in work for 6 months. So I've pulled them up on the different terms in my policy to the MPI which they extended to my policy which states I can make a fresh claim after 3 months back in work as long as they hadn't paid the full 12 months from a previous claim. Got them by the bullocks but still awaiting a response to my complaint. If not in my favor, sod FOS and FSA they take forever. Pass GO and proceed straight to court.
What I can't understand is how many different companies have been involved with this one income protection policy.
I took out the policy in 2006 with a company called Choice Insurance, the documents provided came from Adminicle, then I got something in the post from Assurant, then Adminicle again. How the hell do these companies actually know what they are doing in the first place.
Another thing I think should be looked into is the Terms and Conditions. I have a number of policies which all state that after 3months/ 90 days back in permanent employment you can start a new claim and this one is 6 months. they should be standard across the board.
And yes my premium went up, but I find it amazing that these companies have had it so good for 15yrs and then the !!!! hits the fan and they all go off crying into their milk for help like the banks. It's liking gambling, they did and lost. I cant go ask for my money back if I lose everything.

After reading this thread i sent an email to admicle regarding the increase in my payments - they doubled overnight from june 2009.
I have now received a reply with a number of attachments (these attachments are all letters that have purported to have been sent to me over the last years but which i have never seen).

Thank you for your confirmation.
I attach the letter sent to you in January this year advising of the transfer of administration to Trent Services. I also attach a response from the Underwriters regarding your refund enquiry. You will see this makes reference to a letter sent by the previous Administrators (Adminicle) in April 2009 regarding the change of Insurer and first Administrator change, and I have also attached a copy of this.
Your policy was transferred to Alpha Insurance A/S from 1st June 2009 – not Arbuthnot Latham (who you have mentioned – we are not aware of this company).
If you have any further queries, please do not hesitate to contact us.
Kind regards"
Now one of these letters refers to "my correspondence ", i have never received any letters yet alone sending any letters out.
Could someone kindly explain what i have to do to get my money back. also can i now change my provider and still be entitled to my money back if successful or do i have to stay with these monkeys to get my money back.

Thanks mondeotd... I have writen to british insurance and the fsa and thats post is about the most information i have had. Noone else seems to be able to tellme what is happening they are all just blaming each other. Hopefully if the FSA are trying to negotiate then this will be resolved soon and in our favour... My fingers are crossed.0

Hi, thanks MONDEOTD. I've been watching this discussion for a long while now and finally sent off my letter to Trent after the June deadline came and went without hearing from them ... and got the same "not us" reply as everyone else seems to have. I was just about to start down the FSA (long) route, but after having seen your post will wait a couple more weeks to see what gets updated on Ant Insurance's site (I hope it's not a fob them off/delaying tactic though).
It is all very confusing though with the number of changes to policy administrators and insurers!!! Currently I believe that the insurers of my policy are Alpha Insurance, with the administrators being Trent, but I'm confused about the link between Ant Insurance and Trent?? Will keep watching for updates and help.:)0 -
MMMM Ant have posted a reply to this in there website saying the FSA has decided there was no breach of contract and we are not entitled to any money. Anyone got any ideas what we should do now or is that it.?0

hey all... have been watching this thread with interest... heres a lowdown (as far as i can tell) of who is/was admin/underwriting these polcies...
Ant / British are the intermediaries who arranged / sell the polcies
Assurant General Insurance were the former Underwriters up to Feb this year..
Assurant also administered these polcies up to june '09. The administration then transferred to Adminicle (member of the assurant group).
In feb assurant advised Ant/British that they were looking for a substantial increase of premiums.
Ant/British then approached Alpha who agreed to provide the same terms at a slightly lower rate so alpha then took over the underwriting.
At the same time the administration was transferred from Admincle to trent services.
And that is how it stands. Ant now say the FSA have decided that seeing as Alpha never actually "increased" the premiums they are not oblidged to issue any refund of premium increase (which makes sense when you think about it)
As such it looks like a poor call on behalf of ant/british to change underwriters after all and they must be held accountable for this!0 -
The issue for me is that the various letters never fully explained what was going on. If they had said cover was ending and a new policy taken out then fair enough but it didnt
If the FSA have indeed reviewed this then its not looking too good, although it will be interesting to see what the FOS have to say on the matter.
Has anyone found out who has conducted this review with the FSA?0
