HBOS Charity Cards - 2% min repayment or 3% min repayment

I thought I would start a separate thread, away from the fees free discution.
Condition 2.2 of the agreement which OH signed states 'Each month you must repay at least 2% of the amount you owe to us, etc' which is the same as the T's & C's on the website for the Macmillan card. However, the first bill came in yesterday, asking for 3%.
OH rang HBOS last night and the person he spoke to said all affinity cards have a minimum repayment of 2% and that there had been a mistake. He first told my husband to only pay 2%, not the amount requested, but I told OH that it had been set up by DD. The guy at HBOS then said they would amend the DD and take 2% and not 3%. .
Today, there have been further developments today. A lady with a Scottish accent telephoned the house this afternoon, asking to speak to my husband on a banking matter. She said it was not a sales call and in response to a telephone call he had made. She would not say which organisation she was calling form. When she told me she had the office number, I suggested she call him. I got to him first and suggested that this was a continuation of last night's call. Needless to say I was correct.
The long and short of it is, HBOS have no idea what T's and C's they sent and have asked for a copy, to which my husband said no. She was fairly insistent that it should have been 3% and he told her to go away and have a think about it. He told her that if the DD goes out for the incorrect amount, ie 3%, even though he was told last night that it would be 2%, he will have suffered a financial loss and take the matter further. Supposedly she is going to call back on Friday.
TBH, until the DD goes through, we won't know how this is going to turn out. However, at the end of the day, OH signed T's & C's for 2%, not 3%. Personally, I am unconvinced, and will wait with baited breath for June 6 and see what comes out of the current account.
The woman from HBOS did telephone OH yesterday. She apologised for the confusion, and admitted that it should be a 2% minimum payment, and that the DD will be adjusted accordingly. Let's just wait and see.

I signed up for the Macmillian card earlier this month.
Their website clearly stated at the time, and still does that the minimum repayment is 2%.
They sent me a credit agreement form to sign and return which stated the minumum repayment was at least 2%. I took this to mean you could pay more off if you wanted to but 2% is the minimum required to avoid penalties.
However when I recieved the card, the letter is was afixed to contained yet another copy of the terms and conditions but this one stated the minimum repayment was "at least 3%"
I immediately queried this with their customer services. At first the girl was adament it should be 2% but after going away to seek clarification she came back to say it is indeed 3%. She told me her colleague had expained that in saying "you must repay AT LEAST 2%" on the original agreement this gives them the ability to increase this at any time without warning. I told her I thought this was incredibly bad practice and she agreed.
I told her I would never have applied for the card in the first place if it had said the minimum repayment was 3%. She offered to forward my complaint to their complaints dept and said I would hear from them in writing within 5 working days.

It definitely says 2% on the t&cs I printed out when I was doing the online application. However all the stuff they sent me to sign was 3%, so that's what I'm paying.0

OH received a telephone call from HBOS this morning from the nice lady who apologised for the confusion a couple of weeks ago. She has managed to find the paperwork he signed, and yes it would appear that this confirms 2% minimum repayment. However, she then went on to say, that another department is querying this and believe it to be wrong. OH was gobsmacked. They have the original agreement which he signed which states a minimum repayment of 2%, and they think it is wrong. He became somewhat sarcastic at this point, and suggested that even though the laws in Scotland might different to those in England, he believed that the credit agreement he signed in this country would be upheld in an English court of law, or words to that effect. She again asked if he would be prepared to supply a copy of his paperwork. He reminded her that the last time she asked this, he told her that provided HBOS paid for his time, he would be happy to accommodate this request. He further added that his costs had now increased and should they wish to pay him £50, he will be happy to supply the copies of the paperwork. She has gone away to think about it.
The first payment goes out on 6 June and we wait with baited breath to see how much they take. I don't want to be the person on the receiving end if they take out 3%.0 -
Would be tempted to go for one of these charity cards, but with all the hundreds of people who seem to have had problems with minimum payment amounts and balance transfer fees will give them a wide birth. Seems like HBOS have made a right pigs ear of the t&c's and that half of their customer services don't have a clue as to what they all actually are0

Just checked online, and the dd has gone through at 2%. Will just have to wait and see what next month's statement says. Hopefully, it will have been corrected to 2%, but with HBOS, who knows.0

The June statement arrived this morning and the minimum monthly repayment is, once again, 3%. OH is going to have to have further discussions with HBOS.
It is not a question of not being able to afford the extra 1%, it is the principle of the matter. The Ts & Cs OH signed said 2%, and that is what he will be paying.0 -
My statement the DD is for £170 and the balance transfer was £8500. So 2%.0

The nice lady from HBOS telephoned OH again last week and again asked for him to provide them with a copy of his agreement where it stated 2%. He again asked if they were going to pay either him or make a donation to charity, to provide this copy, and she said no. The dd has again been adjusted to 2% and she will be in contact with OH next month, when she gets back from her holiday to continue the discussions.
This seems such a pointless exercise. Why don't they make the adjustment permanent, and should they, at any time, find their copy of the agreement (which they obviously can't), write and apologise.
As long as they keep adjusting the dd to 2% each month, OH couldn't care less, but woe betide them the first month they don't.0 -
I am having exactly the same issue with BOS. They have just phoned, left a message, clarifying that they have spoken to the department concerned, and can confirm that the minimum is 3% (not the 2% I agreed to)Just done my fee free balance transfer with this card as recommended in Martin's article. (I notice the card is no longer there)
When they sent me the Credit Agreement the minimum payment was listed as 2%
On the sheet the actual card came on it said 3%
I queried this and had a phone message to say it has been an issue with all these cards but it is now 3%.
This isn't the June/July HBOS changes letter issue (that had other changes on it)
So where do I stand? I agreed to 2% and they want another £40 a month.
Also, has anyone else noticed this discrepency or is only paying 2%?0
