    Good luck fizzel81 with getting your locks fixed, have you got anything heavy that you can maybe put behind the door so nobody can get in?

    I loathe the way these companies work, surely if they don't have your permission to enter then it's illegal, I suppose they don't care though, do they?!

    I'm now on edge whenever I hear a car pull up outside, I just wish I had the £329.00 to pay them in full so they can leave me alone!

    I owe then £1125 and they never visit me, mind you they don't phone either as they learnt the hard way I won't deal with them. They have rejected my settlement offer so a bit pee'd at them.

    its an open out door, im cross with dh as i never open it as its always been hard to lock again, he went away for a week today leaving it unlocked its prob been unlocked since last night, i now feel more stressed the felt all day as if i ignore this person now then he will just come through back gate(which is just a latch) and let himself in, ive tried and lost temper with back door so many times now, tried locking from outside but cannot get key all the way in sop its a no win situation, i feel like he will now just come in and take what he wants

  • I didn't think they could do that without a court order. And if he did come in without this would it not be classed burglary? And youhave the right to defend your home using reasonable force. Maybe someone else could clarify?

    As far as i'm aware (someone please correct me if i'm wrong) these people are not bailiffs they are just debt collectors and have no right to access your property unless you invite them. They would need a court order to force entry so if one of them enter your house uninvited then you should be able to do them for tresspass.

    I've also had dealings with Moorecroft regarding NTL who have been billing me every month since I cancelled last July so I have written to them explaining that I do not owe NTL £272 as they state and that I am not willing to pay money I don't owe and enclosed a copy of the letter I sent to NTL. Haven't heard anything from them yet but it still early days although they have been phoning almost every day but I don't answer. If I have further dealings with them I am going to tell them not to contact me by phone only by letter as it's so annoying getting calls everyday.

    My advice is like everyone else, don't let them in and contact them and tell them you are not willing to deal with someone at your home and will only deal with them by letter.
  • I think every one is getting a bit excited with reguards moorecroft debt collectors they have no right of entry in to your property a bailiff has to have a court order to get that in,in the case of unsecured debt you would have had to be taken to court a judgement issued and if if you have not agreed to pay in in stalments the creditor can then ask for bailiffs to be involved debt collectors have no powers other than to ask you simply refuse to pay if cant afford it ,make an offer and stick to it,i dont hold to this dont answear the door clap trap its your home for gods sake if its a debt collector answear it if he enters he is breaking the law(he wont barge in) and to be honest id thump him or call the police this block your doors etc advice is both stupid and dangerous rule of thumb if its a debt collector you can tell him to !!!!!! off you are under no legal obligation to pay them if they want payment you tell them what you can afford by post or at a bank only,dont let it get to bailiff level as you have less rights but remember they cant enter with out a court order and debt collectors move them on and brush up on your rights but dont be intimidated
  • Do not let them in they are horrendous. I have a DMP with CCCS and had an account with Next which was passed to Moorcroft. CCCS then contacted Moorcroft and they have never acknowledged any of the contact from CCCS and have since kept writing to me and sent a claim form supposedly from court. They have complete ignored all my letters, phone calls to them and all those from the CCCS then they sent me a claim form from someone called MSL Solicitors (which turn out to be Moorcroft also).

    They have now accepted the amount I am to pay them via the CCCS but have added on another £200 supposedly for taking me to Court. They didnt take me to court and I dont think what they are doing is legal so have sent it all to the CCCS.

    When I have spoken to both MSL and Moorcroft they are exceptionally ignorant and rude and stubborn so do NOT under circumstances let them come to your home, they do not have a right to entry. I dont know what they would be hoping to acheive by doing this if you have already sent them your income and outgoings.

    Is their address in Stockport? P>O> Box number?
    you pay what you owe the added amount put on by moorecroft when it gets to that amount stop paying and dispute that amount and see them in court dont pay it the court will side with you in most cases in my debt days they did im now debt free but you dont get that way by rolling over and paying all these extra trumped up charges

    It is the 'fear' of someone turning up on your doorstep that they are relying on to get you to commit to more than you can afford. Remember, this is their business and a lot of them are very good at it.

    Debt collection agencies do have a license to make 'site visits' (within reasonable hours) to your home to attempt to discuss the matter with you although they very rarely do this because it costs them a lot of money.

    However, they have absolutely no right of entry, they have no right to take anything from you and you are under no obligation to discuss anything with them.

    Very often you will get more sense from a visitor than you would with someone calling you over the phone so I'm not saying categorically don't discuss anything with a collector if they do turn up, but I am saying don't feel intimidated and don't feel obliged to do so.

    If you are not comfortable discussing the matter with a visitor, keep cool and ask them to leave, if they refuse to leave, tell them they are trespassing and that if they don't leave, you will call the police. If they remain, call the police, tell them that someone is trespassing on your property and there is likely to be a breach of the peace.

    Stick to your guns, stay completely calm, and you'll be fine.
