    Have you done your rebate complaint now Di? Or are you going the misselling route through the inurer? Have you contacted the FOS yet?

    I put in a credit card PPI complaint to Cap1 about this time last year and got knocked back after the 8 weeks and stupidly never took it to the FOS. my question is will the order to reopen cases cover ones like this?

    I have wrote to the Insurer, just to give it a go and enclosed details of their policy, on the grounds that we think this policy was unfair, and mis leading.
    Will give it a go and see what they come back with, not holding much hope, so its basically about the mis selling and the rebate.

    So no not heard nothing since from the FOS, so thought we would just get on with it anyway.

    We worked it out that the 6 months will be up by the end of this month.

    Found loads of HFC correspondence/paperwork within the SAR as well, have wrote to them to ask who was responsible for working out the rebate, that is only a query though.

    I would think so. Can you not "jog" their memories;)

    So that was lucky then if you made the complaint for misselling as well and it was just within 6 months. Didn't you already make a complaint to them though that FOS did for you?? I had the FOS write for me.

    We worked it out the other night, so thought instead of waiting for feedback from the FOS, we got on with it, in case times runs away from us.
    The FOS did write to them to ask them who were responsible, they wrote back to the FOS with no explanation but given HFC's address, that was it.

    I did not have this policy then though, and because if now since there have been lots in here mentioning the insurer, thought it was best to write to them myself and try.

    I do actually have a complaint against FP and it was dismissed by an adjudicator and this is the response. It must still be open as I asked for it to be kept open. This is the snotty email I got when I complained. Just waiting for the Ombudsman now.


    Thank you for your email of 14 January 2009 requesting that you are awarded with some sort of stress money from Firstplus as it should have directed your complaint for the rebate issue to Lloyds of London in the first instance.
    I have considered your comments. The file papers indicate that you raised concerns with Firstplus about the settlement figure provided on your loan account ******. Firstplus addressed your concerns about the settlement figure in its final response letter dated 8 May 2008. Your complaint form makes reference to concerns about unfair rebate, which Firstplus did not address in its final response letter of 8 May 2008. For this reason I do not agree that Firstplus should have directed you to Lloyds of London as it did not address a complaint about rebate.

    I contacted you in October 2008 to inform you that your concerns about unfair rebate should be directed to the insurance company who underwrote your policy. As it was not clear who originally underwrote your policy, we carried out various searches in order to ascertain this information.
    We only award compensation for material distress and inconvenience. It is my view that there will be an element of distress and inconvenience in making a complaint, however it is not enough to warrant a compensation payment to be made. My view remains that we cannot consider your complaint against Firstplus as it is not responsible for issues concerning unfair rebate. If you do not agree with my view, you have the option of having your complaint referred to the ombudsman for a final decision to be made. If you wish to proceed to the final stage of our procedure, please let me know in writing by 5 February 2009. If I have not heard from you by 5 February 2009 I will arrange for your above complaint to be closed.




    Needless to say I asked it be looked into further by the Ombudsman. I made a complaint last April about the rebate and FOS have had it ever since but it took until October and after being reviewed twice for them to direct me to the insurer. I do keep getting a letter every now again with this complaint number on it saying "still waiting" but that is since Feb 09. In fact the manager I spoke to last time about my Lloyds complaint said that I have a complaint against FP still open. Well its only a compensation one for giving me the run around as I felt they did but not likely to be upheld cause even the adjudicator said I do not deserve it. They usually all stick together. Also they said that is not clear from any correspondence they held of who actually sold me the policy. I told them it was Bespoke as they had held up their hands. I know this will be back to me soon with a "no, sorry, we do not think that FP did anything wrong". I just wanted to exhaust everything really as I was so annoyed at the time.
