Like I said earlier - this thread has spiralled out of control.
Contact the "deposit people" - whoever they are - ask them what the procedure is for the carpet and let them deal with it - that is what they get paid for.
As for the damp - wait for her to move out and then get the relevant people in to check it.0 -
Two damp proof people booked to come in in the 2 days after tenant leaves. She telephoned my husband last night with threatening to take him to Court for damage to her clothes and handbags and shoes due to damp! I still insist it's condensation. One of the damp course people said he 'would not' come into the house until after she had left as he had in so many occasions had a terrible time with tenants when he told them that it was condensation and not damp.
Clutton.....she is demanding to see the damp report we had (no damp found) done before she moved in, saying it's her legal right to see this document!! My husband took your advice and is not giving her copies of it....should we need it in future.
Because of this, she is refusing to put her notice in writing......

Estate Agent says the money was put in to a scheme with a company they no longer use called Lets XL.....our tenant apparently has been paying into this every month according to the EA. They now use one of the Govenmrent schemes...
The EA said that if we tried to pursue for the carpet we would end up with nothing as this company Lets XL will reduce cost of carpet by 50% in first year and then keep knocking money off for this and that and in the end will wangle it so the literally will only be paying out for a piece of carpet the size of the iron burn!! Can they do this??0 -

I do believe that the chap who was running it 14 months ago was carp, but the chap I spoke to yesterday was or seemed very professional. Saying they are crap is one thing, but why do you say this.....the dispute would be with the people who hold the bond?0

Your EA has said they used a scheme that effectively gives you no recourse, and is trying to put you off even claiming it seems. You also imply that they still use this scheme for your tennant, yet switched to government ones for newer tennants. If they had a problem with the old scheme (which it appears they do, as they say they wont pay out) then they should have arranged to move your tennant onto the new one. To me, that makes them a bad agent.
Also, I don't understand why the tennant pays into it every month. Do you not hold a deposit at all?0 -
Tek Monkey - no we hold nothing, nor do the estate agents. I have the number for the Lets XL people.....perhaps I should call them myself? Yes, the Estate Agent very much tried to put me off claiming for the carpet, saying they wouldnt pay out. The Agents were only responsible really for the first 6 months of the tenancy, then the tenant stayed on of her own accord. They want £65 to go back in and do an inventory when she is leaving, and they say we will need this in order to make a claim for the carpet, but he says that that will outway what the Lets XL people will give us for the damage done. We feel really hard done by, by this agency, seems that they had a bond scheme going that is basically useless as we have a damaged carpet and cant do anything about it.0

Ah, so they just pay insurance not a deposit? Not sure I'd be happy with that, as they have no threat of losing something if they trash the house. At least with a deposit you stand to lose it, every place I've ever rented has wanted 1 months rent plus an extra £100 before I could move in. This effectively means paying more than double the rent for the first month, which sucks but I suspect keeps you more appreciative of the house.
I am looking to move again soon, and am very concious of losing my deposit should the house not be up to standard. It is, I've actually redecorated some rooms! It appears she has nothing to lose though?0
