    Sorry Far that you are having all of this, it must be very painful & frustrating.

    I think you have to go with your soliciter's advice - they 'see' these things alot more than you would believe.

    Hi All - well here's the update!!

    I can't believe it but today my siblings have given way and offered me my full 1/4 share of Dad's estate!

    I am obviously delighted but it has knocked me for 6 really - I was really ready to have to go through Court - it seems to put an end to it all.

    Naturally I feel a lot of emotions but I have to say that I am SO SO SO grateful to the "friends" on here who have advised me and encouraged me to go on fighting.

    It does show that justice does win and I can now concentrate on doing what my parents would have wanted me to do with their money.

    One last question however, the letter states that "it is in full and final settlement of all and any claims that your client has against her father's estate or any beneficiary thereof or any matter arising from the will and estate"

    My Uncle has advised me not to sign based on this statement as, his words, "what are they trying to hide now!

    I do see his point but just wondered what the legal opinion is??? I do ask my solicitor but he gets too legal for me!

    Hmm, I'm in no way a legal eagle but I thought that clause was pretty standard. I thought it was just to say that this settlement draws a line under the case, and you won't change your mind and take them to court about the inheritance again in say 5 more years. (Not that I think that's the case, but just an example)!

  • Hey far, I've ben lurking from the beginning, and just wanted to say congratulations. I haven't commented before, and won't now because I don't have a clue, but it seems common sense prevails. Enjoy spending your inheritance, as your parents would have intended.

    Good to hear they've backed down at last, and well done you for sticking it out, it can't have been easy.

    My interpretation is that you won't make any further claim on the estate or them. In other words, if you accept the 1/4 share you won't pursue for anything else, ever, including what it's cost you in legal fees or a share in the gold mine that's subsequently discovered at the bottom of your dad's garden. HTH

    Errata is (as usual) dead right and so is the other poster - its standard hun, and means the process is ending - not that they are hiding anything - for a solicitor to do that is almost unthinkable - he would be struck off!

    I am so pleased that matters have been resolved this way - sounds eminently fair and what your mum and dad would have wanted!

    This is something you need to discuss with your solicitor. Ask them to explain very clearly and each time you can't understand what they've just said, ask them to explain it more clearly until you do.
