Fixtures and fittings!

Get the fixtures and fittings through from my sellers and I'm fuming.

Firstly EA details clearly stated range oven included in property; sellers have excluded it!

Also excluded are all light fittings, dimmer switches, picture hooks, curtain rails, shelves, toilet roll holder, soap dishes. Grrrrrr!

The sellers are going to rent, is it really necessary to take all with them?

For my buyers I've already said I will leave the net curtains, curtain rails all bathroom fittings, all light fittings except shades. Why can't people be reasonable?

    I'd try and renegotiate the price, as I'm sure I read somewhere that if appliances/furniture were included in the property details then they were seen to be included in the sale. Worth checking this one with your solicitor.

    All the rest is just annoying, although picture hooks????

    Not true unfortunately, all you can do is talk to the EA about putting false details into the description about the cooker being included.

    If its gas then they have to leave a cooker attached to it, but it doesn't necessarily have to be the one that was already there.
    It's not easy having a good time. Even smiling makes my face ache.

    OH poor you, people can be soooo petty, when we brought our house the vendors even went to the extent of taking light bulbs and left bare wires hanging out all over the place where they had taken wall mounted lights etc (which incidently is not legal and you can do something about this if you find the same when you move in). Unfortunately, any fixtures and fittings that were mentioned on the EA details can still be withdrawn from the sale, as the EAs details are pre sale and therefore as part of the negotiations on price they can be withdrawn from inclusion. The only time something is set in stone is when it does go onto the fixtures and fittings list.

    As above, I would try to renegotiate the price before you exchange, tell the EA that you feel that your offer was reflective of the fact that on the details were x, y and z and that the vendor has renegotiated on this etc.

    Its all worth a try, there is also a possibility that the vendors have filled the form in wrong and the solicitor hasnt questioned them about it. Beleive it or not I have seen this done a few times, its a long shot but worth a try.

    I will speak to my solicitor, that cooker is going to cost over a grand to replace. if I got a smaller one I would have to get a carpenter in to fill the gap on either side. I based my offer on it being included so I do feel hard done by.

    The other thing to double check is the carpets, if they are being so unreasonable. After finally agreeing a price, our vendors then said a week later, when pushed, that no, unless we coughed up another grand, they were going to rip out all the carpets! Initially we pulled out on principle. Granted, they were nice and very (practically brand) new, but it still seemed a bit cheeky. That still grates on me. They should have just been honest and said *they'd* changed their mind about accepting our offer. Then *they* would have been the ones pulling out, rather than making it look like us.

    But we had fallen in love with the house, didn't see anything nearly as suitable for the same price, so when it was still up a week later, went back. Of course by then there was apparently another interested party, offering 'considerably more' (which I could well believe) and we were invited to place best and final offers, but we refused (only so far I could ignore my pride) to offer more. Apparently to the EA's great surprise (HA!) they re-accepted our original offer as we had already exchanged on our house and the other party was yet to exchange. (Although we conceeded and agreed to pay the grand for the carpets as it would have cost more to re-carpet to the same standard).

    Incentally (and I've always wondered this ever since) what ended up happening was that the final purchase price was upped by that grand and carpets included in the fixtures and fittings. I would have thought that if they were being sold as an extra, the actual purchase price of the house (and valuation for mortgage) should have stayed the same. Not that it made any difference in practice (the mortgage valuation tied in with the new price and we just borrowed an extra grand). I still think the house was definitly worth it at that price and have no regrets. But could have been an issue if close to stamp duty boundries.

    Oh, and when we did move in, found that they had taken loads of stuff the f&f list said would stay (eg toilet holders and towel rails taken off the walls).

    Is this true? I didn't realise you had to leave a cooker if it was gas. We are intending to take ours as it is only 2 months old.

    When we bought the house we are in now, I was gobsmacked when they asked for £150 for the carpets (or they would rip them up), £100 for two light fittings and £50 for the bathroom fittings. Unfortunatly, we had lost out on over 30 houses and was quite desperate for it to go through, that we just coughed up. We had never paid for carpets before and had left ours and many other things, like blinds and curtains for our buyers as we didn't need them anymore.

    Yup. I think we must have one of the only ethical estate agents left in Britain here in Scarborough, but the bloke that showed us around the house (not the same one that is dealing with the transaction though) said that if there is a gas cooker point then you have to leave a cooker connected to it when you are selling because of regulations incase we were thinking of negotiating with the vendor over it, however if it's electrical then its fair game.
    It's not easy having a good time. Even smiling makes my face ache.

    We've just moved, problem-free thankfully, but when we purchased previously, the vendor wanted us to purchase the (rather-rammy) carpets separately - we said no.

    When we got the keys, we found that not only had they ripped out the carpets, they had shoved them down the side of the garage in the garden!

    How awful that some people can be so spiteful. I can't believe they went to all the trouble of taking up the carpets just to be mean.
