No, the employees of Tesco (or their parking control agents) have no power or authority to issue a fine. They can give you an invoice for parking, and if you are so inclined you can pay the invoice if you feel you made a contract with them.

If you don't feel the need to pay the unsolicited invoice, you can ignore them. There have been many posts on here (and the pepipoo forums) about the illegality of private firms trying to issue "fines". They have no standing in law as a parking fine (a parking fine can only be issued by the police or councils, or their agents).

Whatever you do, don't pay. While it's wrong to park in a disabled space if you don't need to, the guy who ticketed you didn't know you weren't a blue badge holder. There's no obligation to display a blue badge in a private car park. While the landowner has an obligation to provide disabled spaces, there is no legal obligation on the driver not to use them, as there would be on a road or in a council car park.

What you have received is an entirely unenforceable invoice. Put it in a drawer and forget about it. DO NOT contact the company! DO NOT pay! Just forget it.

sorry this post is very late.but it says on a sign that you will be fined £70 if you park in a disabled space. do you think we should pay? t will be £50 if we pay tonight.

As has been stated above, this is NOT a fine if it has been served by a private company. Only councils and the police can issue fines. If you received this ticket from a parking company then it's just an invoice and cannot be enforced. Just forget about it. They might lie to you about taking you to court or sending in the bailiffs. That is all hot air. They just won't bother. See post #23

YOU WILL GET PHONE CALLS FROM DEBT COLLECTION AGENCIES SUCH AS CCS COLLECT AND ROXBURGH. YOU STILL DO NOT HAVE TO PAY, SIMPLY TELL THEM TO REFER THE "DEBT" BACK TO THEIR CLIENT.

Do you mind if I ask if you or a passenger were disabled? If so, why did you get a ticket/ invoice? if you or your passenger were not disabled, why were you parking in a disabled space?

Law of contract is the same in Scotland and England.

As for Casey's comment, as there is no legal obligation to display a blue badge in a disabled space in a private car park, the attendant would not have known one way or the other if the driver or passenger was disabled. It is entirely irrelevant (although it's not on to use the space unless you need to).
