parking fine

Hi
have recieved a parking ticket for parking in a disabled bay This was at 10 o clock at night when the car park was virtually empty I just pulled into a bay not thinking I got out of the car to see if she was comming I walked some 50 yards less than 2 minutes When I returned there was an attendant taking details of my car I feel he was watching and waiting to see if I got out and left my car result £40 fine if I pay in 14 days or 75 if not paid.
Should I pay

    Tesco can't fine you, any more than I can for taking too long to read this sentence.

    Disabled bays in private car parks have no legal standing (except in Scotland). It's a scam, don't contact them, ignore all their rubbish letters and never pay them a penny.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
  • The person recieving the ticket was not driving should they reply saying it was not them driving. How could they pursue the real driver

    It is a scam and Tesco can no more fine you than I can.

    You will get a few scary letters but are safe to ignore them.

    They are playing a percentage game.

    Just forget about it and enjoy your life.

    UKPC are just another private company. They have as much right to fine anybody as your plumber does for having a leaking tap. They are well known for writing threatening letters, but no history of taking anyone to court.

    Would you reply if you got an email from a Nigerian Prince who needed to borrow your bank Account to deposit a few million quid? No.

    This is a similar scam but by snail mail. You will have to endure and IGNORE several threatening letters before they will go away (they will). If it helps, post about the letters on here each time you get one, to get it off your chest. You will be told you can safely ignore every letter.

    My relative who got a ticket in Tesco has had a couple of letters already. They are very pretty with bright coloured borders and bold capitals. But they won't get a reply from us.

    Please spread the word among your friends and relatives about this scam.

    Safe to IGNORE all from them, do not pay them a penny and do not contact them.

    By the way it is not a fine, only the HM Courts service can fine you, councils and the police can issue penalties which have to be paid or appealed, private parking companies issue invoices and can be safely ignored.

    I agree.
    On a point of order I add this.

    Councils and the Police do not issue penalties, they issue Penalty Notices.
    The statutory process behind the issuance may result in the financial liability - the penalty - being enacted at a later time. It is only at that time that the penalty is crystallised i.e comes into being legally.
    Although this may seem to be splitting hairs it is in fact fundamental.
