POSITIVE AND FOCUSED, I have just rang the TCO about the overpayment, and its not even on record in the main office, so im filling in a dsisput form as we speak and have sent off for a subject access request
now, since 1pm, my husband has rang santander, who he says were quite patranising about his speech (which has also encountered difficulties since the crash), he said they told him to send the disput form, unsigned and ripped in half with a covering letter, which he actually posted last night.lol and that should be okay, hes confirmed to santander that he never disputed anything and just wants them to accept the DMP as that section on the DMP is joint also.
meanwhile im disputing all 3 credit reports and attempting to reclaim TCO NATWEST AND BARCLAYS, goodness knows whether anything will work.

hes still quite as sceptical as i am about santander, didnt think it had this much an impact on me but ive just checked me cupboards and either hes sneaked in a full shop, or we just keep forgetting to eat every time we discuss and think about the debts and the crash. bit of an update since the 21st:
havent heard anything from santander since then,
tax credits have sent (IN WRITING) saying they will compensate me £267.95 of the overpayment by knocking it off the balance, now stating it at £2512.51, dont know whther to take it as a stingy offer /compromisation or an insult from HMRC.
Barclays have still kept increasing the charges,, as they havent accepted the DMP as of yet despite the long long wait. Now at £320.39 thats like £96, technically i could say really that ive only gained a reduction of £171.95, welcome finance has kept increasing their interest and defaults as expected and now is bang on £300 so thats another £50 gained, and are starting to accept offers,
Total reduction of £121.28..LOL after sending out 18 stamped addressed envelopes, 7 emails and 25 phonecalls later, which a total spend of £21.15 ive really only been reduced by a hundred quid.
all that time and effort for sweet nothing, just goes to show, that no matter how hard someone trys its not always worth the hassle in the end.Legal Fees £1325.00

first of all - you say you have a DMP with a fee paying company? DITCH THEM!!!! now!
Either manage the DMP your own with help from here or contact one of the charities in my signature - they won't charge you for the priviledge and you're more likely to make progress with getting charges stopped than with a cowboy outfit...
Number 2 - no idea about tax etc over payments - personally I think if you were paid it and it was incorrect then it should be repaid - but I appreciate that is my point of view
3 - your GPs notes should be saved on back up media. I've been involved in maintenance of the systems GPs use and most use them

the dmp ive had for 18 months and i started out with nearly 12 grand debt, after starting out at 9 creditors, 3 have been written off, and 1 was reduced and paid, and another was paid off, ,im down to 4 creditors 1 of which the dmp company wont allow (tax credits), the dmp company has said that it looks like these remaining 3 creditors on the plan are starting to accept offers, i started with the cccs and the wait was that long, wioth no one budging i couldnt afford to wait any longer as my debts were doubling on their plan, thats why i switched to paid dmp firm, and things have moved quicker from the other 5 creditors i had. I think where tax credits are concerned, im in for a lonf#g wait and they're in for a long fight, as for santander, they are one of the acceptances since the 21st and my husbands making more progress every day, hes had no calls or pestering from santander, but neither has he had a recent statement from them, whether or not thats because they accepted the dmp i dont know.Legal Fees £1325.00

lol, in the last 10 minutes barclays have contacted me saying they will make a reduction as offering today, but the rest they will accept on the dmp, but, they will reduce my debt by ....
are you all ready for this everyone?... a whopping................ (£3.39)..LOL, talk about taking the p**s, now i dont know whether to laugh it off or be offended by their patronising deal.

Don't mean to scare you but debts are never "written off"... they may have given up chasing for now but they have until 6 years after the last payment or acknowledgement of the debt to pursue it... so unless you have a letter addressed to you stating that they consider the debt settled and paid in full and will not themselves pursue or sell or let an agent of theirs pursue the debt then it's not written off...
If they are saying it is then please persist in getting written proof that they consider the debt as settled in full and will not pursue it any further in future.
Remember with your debts that you should and could pursue them for unfair bank charges - either get them paid to you or taken off the debt. Just follow the usual instructions from the reclaiming guide

Oh and another point... I agree their offer is very low - however... they don't infact have to agree to a DMP or reduced payments. Granted if you can't pay then you can't pay - but they then have all legal rights to get a CCJ against you and if applicable they can put a charge on your property if you own one...DFW Nerd #025DFW no more! in relation to the 3 debts written off, the last payment without the dmp on all 3 of these debts was made on the 6th the 7th and the 18th of july 2003 , then i ran out of money after forming these debts in 2002 at the age of 17, i have recieved written proof off all 3 of these debtors between july 1st 2008 and september the 16th this year. they are no longer on my credit report.
Also as for barclays, despite my dmp, i have disputed these through the reclaiming channels already as i stated earlier on in the thread on the 21st at 2.45pm. I am a council tenant so they cant take nothing from me, if they ever did send baillifs round, everythings freecycle,apart fromn the fact that the tenancy is not in my name.:rotfl:
as for the dmp i pay out £20 pcm , and that was for 3months, that ended 15months ago. i started out at £11890.04 but only £9000 was allowed on the dmp, difference being tax credits, now, without the tax credits im outstanding at 2320.39Legal Fees £1325.00
