I am glad the person got some good advice and assurance not to pay scammers, I cant believe they get away with this stuff. I also got a so called "fine " from shopping too long. The car rental company gave them my details and charged me 34 quid, I had murder with them and got it refunded but had to kick up a fuss. does any one know if that is legal to give your details to a private company as they are not a governing authority just a bunch of t...ts

Cool I like that, I am sure they wouldnt like losing 60-120 quid off the bat, Its such a shame these scams are going on trying to get money of good people. WE need to pressure the stores to get rid of these bandidos:T:T0 -

I got one of them stupid buts of paper saying I had to pay money, no chance of them getting one pence off me. Only problem was the car hire company passed the fine on and charged me... and took 34 pound out my credit card i had used to book the car. i managed to get this money back but only because they took 2 weeks to post it and it arrived past the pay date. I asked them did they have a legal obligation to pass on my information to a private company and she said no. Where does that stand with the data protection act ??0 -

Unless your hire contract has a get out clause which gives the Hire Company permisson to share your data with a private parking company then yes they have breached the DPA.
NB Most Hire contracts only refer to statutory charges/fines/penalties in this regard.0 -

The regulars on this forum have discussed this before and we believe, I think it's true to say, that this is a breach of the DPA.
I think read this thread from pepipoo, it explains in the example emails used - which were successful in getting a hire company to back down - why a lease/hire company have no business getting involved in an allegation of breach of contract (just because it is dressed up to mimic a 'parking ticket').
Next time when hiring a car draw their attention to their own t&cs when signing - see if they will let you add 'signed on the strict understanding that your t&cs re fines and penalties clearly only relate to real tickets issued by an authority/police. A private parking charge notice is not covered'. Or something like that.
If it ever comes to it, use the emails that poster on pepipoo did - they were brilliant and clearly tied Sixt up in knots!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
