    I would think that someone else has set up a standing order for £20 per month which is going into your account by mistake,when they check their regular saver? account they will soon take the cash back off you

    If someone has made a mistake and is sending money to the wrong account, can it be claimed back? How is the bank to know whether it was a genuine mistake or the result of a rift e.g. the sender could be paying for something from the receiver and is no longer happy paying for whatever it could be?

    We all know what the right thing to do morally is, I just want to clarify the legality out of interest if anyone knows.
  • There was a story on BBC Breakfast this am about a woman who has paid £2000 by mistake into the wrong account using internet banking- the bank won't help her get it back directly or tell her who has it (altho' they have written to the recipient who has apparently ignored them !!!!)
    It apparently is a "grey area" under the Banking Codes.
    What annoys me is that if the Bank made a similar mistake they can/do claw the money back!!!

    When I was backpacking many years ago (1996!) in Australia I had a local bank account with ANZ bank. I had £2,000 emergency money in a Lloyds account in the UK and after only 6 months I needed the money. I arranged an electronic transfer with ANZ in Surfers Paradise. Got the money, invested it in beer, pizzas, surfboard. Got back to the UK 6 months later and my £2,000 was still in my Lloyds bank account! Now I'm an honest guy so I told Lloyds. They did not seem to care, told me it was ANZ's problem but that I should not spend the money in case during a subsequent audit the error was discovered. Never heard any more about it. That made me very happy.

    We recently closed an account with ING or, I should say, we tried to for quite some time. They wanted proof of address for my OH.
    We sent it but it was not good enough and then we sent another pile, all current items. They were awful. We couldn't even look at the account on line. All finished now but it was really irritating.

    The story linked to on MSN money says she ticked the wrong box. That sounds similar to Barclays, which gives you a dropdown of people/companies you've paid before. If her bank's online banking works the same way then she should be able to contact each of these people/companies and ask them to return the money. But of course, they don't have to.

    I've often used Barclays online to pay people and I must admit - it's quite unnerving when paying a large sum. I'm double and triple checking. I accept that if I do make a mistake then it's just that. My mistake. But it's an easy mistake to make if you're in a hurry. Unlike writing the wrong name on a cheque or similar.

    But it's a lot easier than having to enter the details of a regular payee each time. It's a trade off of convenience against foolproof. I'll take the convenience. You don't have to bank online, or pay people through it if you do.

    ....the strange thing is, if you spend the money you could be done for theft....there was a case I recall of a woman on benefit who had £75k paid into her account in error...she proceeded to spend it....she received a nine moth suspended prison sentence...
    ...re the £2k woman what I can't understand ....if she had a list of payee's and paid one in error she must know who she paid????

    Maybe there was only an account number and sort code?
