Just got turned down for DLA at the tribunal :(

    Aw, thanks!

    No one in the armed forced. Well my grandparents were in the war, but don't suppose that counts!

    My mum has been on the waiting list for about 23 years, sadly! We do now have choice based lettings, but really only band A and band b, and the occational C get a look in, and we are band E.

    Thank you! I know our local council doesn't have OTs, but Essex County Council does, so I will ask to be put on the list.

    I'm going to have to head to bed now (what a saddo! but been a stressful day.)

    Thanks again for all your help. Will be back again tomorrow!

    I was lowest band and I got an adapted property within about 6 months. I just said every time I applied that I was disabled and needed somewhere adapted. It probably helped that I got DLA though

    Do you live with your mum? If so then she'd be classed as your carer and so carer's uk should help.

    I'm off to bed soon too, need to do the washing up first though. (still waiting for the OT assessment to get a perching stool that'll make it easier... maybe I'll start a book on when I'll get one!)

    im sorry.

    apply again, i know its hard and disheartening but start the ball rolling for a new claim and see if there is a http://www.dialuk.info/ in your area, they will assist in the claims process and form filling, through to tribunal again if necessary but you wont be on our own, and advise what else you might be able to claim. if there is no dial local (use the find a dial link on the dial uk website to find out) then try CAB, again they will help.

    or alternatively may i suggest the http://www.benefitsandwork.co.uk/ website, they have lots of info about disability benefits, and excellent guides available to members (which unfortunately costs, but i think its worth it) and i knwo of many people, myself included, who used their guides and got awarded dla.

    it really is all down to wording, and also spelling out exactly what you cant do, in terms a 3 year old could understand and giving examples for each and every point. an help/advice place should be used to wording it just so.

    Uvitis, fibro, disc disease and ms/ms related (still haven't had it confirmed/denied but the tests are showing the ms/ms related stuff in my body now) oo and hypermobility but that is only slight, and deaf in one ear and loosing the hearing in the other (i keep telling the OH to just get the 12 boar out)

    I've found it a struggle to find out what i can and what i can't claim for, but i found lots of answers with the forum users.

    there was a thread here somewhere, about how a woman helped her friend and what she put down, it gives you an insight on what to write.

    I was advised to write down my days as bad days to give dla an indication of how bad it can be.. dla want to know what you can not do, where as esa want to know what you can do.

    Don't be disheartened, this will just make you more determined that next time they will take you seriously, you have the advantage now, you know what to expect, and you have been very brave, :grouphug:

    As has been said you cant appeal a tribunal except on a point of law to the commisioner,however you can re-apply(as many times as you need to),get help from welfare rights to apply again.

    I knew someone who wanted to claim and had a genuine reason too, but they were turned down..

    One Social Service worker said you need to put down the "worse case scenario"- whether it happens every day/week, or not.

    They then did this, also they felt as if they were manipulating the truth..They sent copies of reports, kept copies of days when things were really bad, and also ticked the box where 'yes- you can contact my doctor or whoever ..etc ? '

    Persevere..send for the form that tells you what the DLA requirements really are, and keep to the truth around that.

    It wore my friend out - being turned down after all that effort, filling in their mega-sized form..but her advice was..try try try again !

    Sadly the nearest is an hour away, because they sound great! I can't travel an hour at the moment. I will probably try again at the CAB, but I didn't find the disability adviser that helpful. I wish there was another charity in the area that could help. I will try that website though, it looks great, thanks!

    Thanks, will see if I can find it. I think just getting all the help I can get will be my next plan of action!

    Thank you! It really does wear you out. I am trying so hard to get myself help, but just keep being shot down. It is difficult.

    I've just phoned community legal advice, and unfortunately all there is in Colchester is CAB. But, they said they have advisors who can help you over the phone. So maybe you could use CAB and then double check everything with them? Add that to the B&W guides and you should be pretty well covered.

    As far as aids go, I can't speak highly enough of DIAL. They arranged for me to see someone (I have autism and sever dyspraxia) who was able to talk to me about what was available and let me see and try various aids.
    I am unable to afford much, but the little things I have, each make a small difference to my life! When my DLA is finally sorted (Please God....make it soon!) I hope to have a little more money to buy some of the aids.

    Thank you so much Ames! I think that is what I will do. Perhaps give it a go myself with the help of the guides, then go to CAB for them to check over and add stuff on. Or maybe the other way round!
