Problems with a used car bought from a garage

  • If the bailiffs come round, you can refuse them entry, and hence can't take anything from you. Whether or not this is a good option, I don't know. Maybe someone else will be able to advise!

  • The DVLA fine ive no problems with, I should have declared the car SORN. Ive a good mind to tell DVLA the garage are the owners of the vehicle now so a new log book go's to them.

    It has caused a hell of alot of stress and worry. Theyve already had 900 quid out of me for a car that doesn't work and no stand to gain close to another £1000 from storage charges!

    This sounds a bit harsh I know, but buying a car from a place like that is only ever going to end in heartache .. my local scrap yard has better stock.
  • As an ex mechanic it is very hard for the customer to regress on the garage as they can be protected by the latin 'caveat emptor', this stands for 'buyer beware'

    I always advised my customers to buy a car all on HP or a least prt of it as you are then protected by the HP company who will help fight your case.

    You really need an engineers report on the vehicle but the fact that so much time as past this would also make it very difficult! Maybe a good idea they are holding your property unlawfully, but ask a solicitor!

    It is a shame that there are still people who want to give the motor trade a bad name...and they should be put out to dry in my opinion!!!:mad:

    Would help if we could somewho see the original bill of sale! Can you not scan it and uploadit on to a photo holding web site and then let us have the web link to see it, might be able to give you more help! Also is there any conditions of sale on the invoice as SOLD AS SEEN is a load of Bull and cannot be used as a get out!!!

    I will have a look at there web site and see if I can come up with anything. What about small claims court as it is a small cost but not sure on how you stand again ask a solicitor or CAB as they sre free.

  • Ive been to solicitor who has told me that ive basically got zero chance of getting any money back form the garage and that I am likely to fact a CCJ or my possessions being taken from me if I dont pay the storage fee.

    I acted on advise from Consumer Direct to return the car to the garage and reject it that way. I had no reply from the garage despite several letters and phone calls to them until the other week when they sent me the demand for storage fees.

    I have been unable to get a mechanics report as they will not release the car without me paying the storage fee!

    The Daily Express has a 'Crusader' section - not every day - where they fight on other peoples behalf - try their website, they may be able to help you.

    Westgate - Hmmm - bit of a warning here for potential car buyers.

    Yeah, I've been think the whole way through this that there must be some way of recourse for the OP. Surely in this day and age of claim for everything, a loophole hasn't remained open to prevent a genuine claimant? If there has been, there's something wrong. But the daily newspaper is an excellent idea! Can wait to see them get a hold of it!:beer::beer::beer:

    I agree, it's one of the worst instances I've heard of.
    Sounds like adverse publicity is the only recourse, :confused:

    Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)
