  • Now how do I stand?
    I made a small order of these which was taken from my credit card.
    THEN I made a larger order - which was flagged by my card provider as a dubious transaction as 10 times the size of my initial order. They therefore declined the transaction.

    My card provider then phoned me to ask me if I'd made this purchase - as this is the way that scams are done, by putting through a large transaction after a small one. They told me they had declined this one to safeguard myself.

    No sooner had I put the phone down then Tesco phoned me telling me that my transaction had been declined. I was advised to re-order the items after speaking to my card provider. I asked if Tesco would honour the price & was told YES! I also asked how heavy the rings were - lady went off to see & came back & said there was no weight provided. She also said she'd had numerous calls asking the same thing! I said that I could understand why!
    I asked again if I reordered would Tesco honour the price - YES was the answer.
    Still waiting for the phone call - all money has been taken by Tesco on 6th & the 8th.

    There is an important difference between this and the B&Q situation. B&Q's own terms and conditions state (or at least they did ;)) that a legally binding contract is formed once money has exchanged hands and a confirmation e-mail is sent out.

    You may be able to argue that Tesco's "contract upon delivery" term is an unfair one according to the unfair terms in contracts regulations but at the very least you would need to prove they had debited your account. If they have, take a screenshot as proof.
  • Just got my phone call. Think I'll fight them on principle - its annoying and it'll be a good chance to get a bit of experience in small claims court (if it comes to that) for if I ever actually need it.

    I suspect they'll back down before then - a few minutes of their solicitors' time will be worth more than my rings!

    And wrt the above post, I dont think they get a choice over when the contract is formed - Ive made an offer, they've accepted = contract formed, whether they like it or not!

    I spoke to Consumer Direct this morning about this issue and they assured me that the terms and conditions on the Tesco site do not breach any laws. They said that whereas I would be able to pursue the matter in the small claims court, it would be difficult to prove. They said the reason for taking them to court would be that they had broken the law by displaying the incorrect price. They said that by taking a payment from my card does not necessarily mean that a contract has been formed.

    I have decided that because the terms on their site appears to be legitimate (which I was in doubt over), I'm not going to bother pursuing it as it was as it seems, a simple pricing error.

  • has anyone actually got their money back yet. I had a phone call in the week stating that a refund would be issued immediately. Checked bank account and still not received refund.

    Well i paid with my tesco credit card, so if they don't refund me, I certainly not paying it and they can chase themselves for it.
