At the end of the day the more that companies feel they can 'create' their own T&C's and be completely oblivious to the law of the land, the more this is going to happen. Im not angry with them, Im not going to lose any sleep over it I'm even half tempted to let it go, but why should I?
I will at least seek advice from trading standards and who knows, maybe Mr T will have to re write his terms and conditions and that may benefit everyone.0 -
Just something I have picked up on on the thread, some people have mentioned that they have got to call someone else to get a refund, but I was not told this, although I was not really listening to him. I think you'll find that even if you were right (which I think you aren't) it really will not be worth your time and effort taking Tesco to court. You might argue that they have bound the contract by taking payment, but I would check that they have ACTUALLY taken the money, rather than simply putting a request for that amount on your card.As far as I was aware, by taking payment from my account, regardless of what Tescos terms and conditions state, they are entering into a contract to supply the goods at the stated price.
I may be wrong though, please advise....
And if their T&Cs say the contract is only bound on delivery (or even on dispatch) then you are unlikely to get far.
Best to just forget about this and move on.

Good luck to chasing this up, perhaps an offer of Tesco voucher/s could be given as a GOGW for the disappointment in not receiving goods because of their error. It wouldn't cost them much and the customer would have to return to purchase, hopefully another "bargain".

My choice of language here Ms Salt, would not have altered the outcome of last nights phone call one way or another, or indeed have produced my paid for and confirmed order
