Typical unilateral terms from Tescos again. They had terms in their Clubcard conditions that were deemed to be one sided and people fought them in court and won if I remember correctly.

Something along the lines of:

Such contract terms may be found to be unfair, and hence legally unenforceable. For guidance on this, we refer to the Unfair Contract Terms Act 1977. In a nutshell, this piece of legislation protects consumers who enter into legally binding agreements with suppliers where the contract is biased in favour of the supplier. Unfair clauses are those which try to exclude any of the following:

Liability for breach of contract. This includes situations in which the supplier did not carry out their contractual obligations (the item was not as described or the service not carried out)

Statutory rights with regard to Sale of Goods and Supply of Goods and Services legislation.

As far as I was aware, by taking payment from my account, regardless of what Tescos terms and conditions state, they are entering into a contract to supply the goods at the stated price.

I may be wrong though, please advise....

I just had the call from Tesco Direct trying to cancel the order. Will be taking it up with Trading Standards in the morning.

I have not had the phone call from tescos yet,but thanx to the above threads.Iwill be prepared to try and not let them whittle out of this one.As they have taken £195 from my account on the 7th sept for the 20 I ordered.Who reckons I will end up getting them .lol.

Did they tell you to phone an 0845 numeber to arrange the refund?

Technically they can't refund you without your permission so they want you to phone them.

Maybe I won't request a refund.

I have had the phone call saying it was all a big fat mistake. i phoned Tesco direct where the woman read from her bit of paper as to what constitutes a contract in Tesco world. Apparently taking payment doesn't count, it is not a contract until despatch. which means it is all on their side.

As soon as I mentioned talking to Trading Standards she said she couldn't discuss it anymore with me.
