Fact is, there is a possibility that pre-April 2007 debts could be unenforceable on legal grounds. This is fact, not disputed.
For those suffering financial hardship and excessive threats or demands from DCA's this is a tool that can be used to make life easier.
This again is fact, some people object, some don't, but it is there and is a tool that can be utilized to attack debt situations.
If you don't agree with this cause of action, then that is fine, that is your personal moral stance.
Why people have to get so uptight when it is discussed is beyond me :rolleyes:

Funnily enough, I thought that was the idea behind credit checks - that the bank actually checked the consumer could afford it, rather than just assume.
Again....too convenient an excuse.
Are these credit checks also supposed to forsee a change in circumstances that the customer has failed to prepare for?
Oh that doesn't matter though, does it, because if the customer loses their job then that is also the banks fault for lending the money in the first place. Silly me, I almost forgot there.:rolleyes:
This almost Orwellian society you dream of would be an interesting one. Banks would not lend at all because they are always 100% to blame for everything, and consumers are always blameless............although of course some are more blameless than others
Consumer rights should go hand in hand with consumer responsilities. Responsibility is something that, sadly, more and more people have grown up with a lack of.

Are you sure that this is not an assumption that you and others who object to this course of action have made ?
Of the threads that I have read on this, I have never seen someone say that they can afford to repay their debts but just don't want to. The impression I have got is that most of them (along with several million others) are actually struggling to repay and in many cases the creditor is not being particularly supportive.
If you are able to pinpoint a case where someone wants to "stitch up" their creditor then I am happy to be corrected.0 -

Banks should demand proof of income or devise a national database of employers linking employees to their actual salary crossed-checked with their bank account transactions to determine income vs. expenditure vs. debt.

Thats true and I agree with you, but then we are all forgetting that the brokers were deliberately telling us to lie in order to get mortgages - the lenders knew this and turned a blind eye - look at all the negative press coverage self cert mortgages get!
I have a self cert and done so because it suited me, not that I inflated my salary but the broker did advise me that I could get whatever house I wanted with a self cert, so long as I had the 30% deposit - so if I had £300k I could have got a million pound pad - ermmm right!
Thing is i'm all for the banks stopping fraud but surely it has to begin at home, within their own ranks....2010 - year of the troll

Why on earth would a lender want to lend to someone who cannot pay? The credit crunch was caused in part by greedy middle men who were stitching up the banks as much as the borrowers.
On a more global scale this is the root of the sub prime borrowing crisis that started in the US - dodgy loans repackaged and sold on to unsuspecting - but pretty dimwitted it has to be said - banks and corporations.
Oh and guess what a lot of these brokers are turning to now that the money has dried up..........you guessed it!.......financial misselling claims! Pot, kettle, black anyone?
