I guess you are actually receiving LHA then as this is in line with the £100 a week you are receiving - even though you are yet to confirm this - despite being asked several times.

sorry Socrates i thought i did mention she is on Housing Benefits. She gets her rent paid via Oldham Housing benefits.

you WONT get this money back - she is on benefits - write it off and move on - that's landlording for you

after having my account locked for some odd reason i am finally back to respond to your question above.
Deposit: No I did not get a deposit the tenant was sourced via a local housing association that keeps a list of people and match it against the available properties. They run a Bond scheme though but that covers me only for damage to the property and not for unpaid rent.
Rent: Weekly rent is £100 but i get paid on monthly basis on £400 on 24th of each month. I know it may sound weird but that is how I am paid by the housing benefits.0 -

You are currently receiving LHA rate. Had it been HB then we had another option.
This is my simple advice.
Try if you can to get her to pay any arrears. Do not hold your breath though!
BUT you have what almost every LL in the country wants a tenant whose rent is guaranteed.
She is not going to lose her job and cannot stop paying you - as you are now being paid directly.
£400 is a lot of money BUT getting another tenant could and definitely will cost more than that.
I would also inform her that if she does not pay her arrears you will inform the Housing Assoc and council and she will not be able to take advantage of the Bond Scheme she is now getting the benefit of in future if she is in arrears and most LL's will not take her without that.
Secondly you could and this is a long shot - fight the council - you have a right to know if she had a history of arrears previously - if she did they should have paid you directly in the first place and have acted negligently.
They will quote Data Protection so this is how you word your question.
"Is there any reason within the current legislation why this tenants rent should not have been paid directly to them - specifically previous arrears"
This should be in writing.
My gut feeling is the HA know here case and she probably has a history of arrears and plays the system.
As I have said before LHA/HB tenants are NOT for experienced inexperienced LL's and for experienced ones you need to know your stuff - its a minefield out there!0 -

That make no sense, if the weekly rent is £100 and you get paid every month, you should be receiving £433.30. The difference over a year is nearly £400.00.0 -

It was a tip I picked up from LandLordzone and when I used it on my LA they answered - so I suppose its regional like most of these things!0 -
i guess it is regional - in the spring i wanted to take on a tenant who had rent arrears in a housing association property - the council confirmed they knew of the arrears, but would not allow direct payment to me "until she is 8 weeks in arrears with yourself" - madness - i didn't take her on - way too risky0
