Anyone had problems with Phones4u?

I recently took out a 24month contract and stupidly didn't read the contract properly (I read it - just clearly not thoroughly enough)
I am unhappy with my handset (N97) and found that the 'good deal' I was offered was actually a really really average (if not bad) deal.
Unfortunately you can not cancel your contract with phones4u - a clause I must have missed.
Now I have 28 days in which I can swap my phone should there be any problems. I've already done this once (original handset had the old software
so swapped to the same phone with upgraded software)
and I'm still not happy with it.
Would it be wrong of me to swap the phone at the end of the 28 day period, renewing my 28 cooling off period and then swapping it again to the phone I want but isn't coming out until October?
I know it sounds complicated but I really am unhappy with phones4u's service and feel I've been duped into two years worth of bills with them so if it's legal, even if slightly devious, do you think I could do it? or are there any reasons for them to say no?

You need to be more specific. Why aren't you happy with your handset, and why aren't you happy with the deal?
It sounds to me like Phones 4U isn't the problem - but more accurately your indecisiveness. You've found a deal, liked it, purchased it, then changed your mind (or seen something cheaper on the internet) and now want to cancel.
Most retailers don't offer 14 day returns these days. Too expensive to give someone a phone, then have to cancel everything because someone can't make their mind up.
In terms of swapping your handset until one comes out that you like - I'd be very surprised if they would allow an exchange to a handset that wasn't available on the date of sale. Each handset that is exchanged has to be sent off to head office, wiped, reconditioned, etc etc and then only has any value as a second hand / refurbed unit. These are handsets that could have gone to people that actually wanted them, and wouldn't keep swapping them for something different. Hopefully, Phones 4U don't get too many customers that do that kind of thing.

The 28 days doesn't reset each time you change phones. Its 28 days from the start of the contract.0

You are better off buying online from the providers,you get better deals and reduced tariffs,I was mis-sold a phone by phones4u in the shop,its a long story.I wrote to head Office and recieved a letter of apolgy from them.i WOULD NEVER STEP IN SIDE ONE OF THERE SHOPS AGAIN.0

Some companies you can actually cancel within 14 days. Cancel the contract, terminate it etc etc.
With Phones4u you can exchange if you are unhappy.
Proc I am unhappy with it not because I'm indecisive but because I explained my needs and that it was vital I had push email to my homescreen. He told me the phone did this but did not however, tell me it was an extra £5 per month (found out when I called vodafone). It has a slow OS one that's not at all suitable for the amount of applications the phone has, of course I wasnt told this in the shop and my brief test run didn't show me it either. there are memory storage problems, internet problems (really bad reception at the most random times) and quite simply, I press buttons and the phone doesn't respond. or performs a task I didn't ask it to do.
I was sold a phone with v10 software when it needs to V11 software to function properly.
If that's not being duped into being sold a dodgy phone I don't know what is and feel I have reason to exchange it.
I've already changed from one N97 to another N97, so clearly I'm not trying to do anything sneaky. I just really do not like the phone (obviously I've given it a fair go to have swapped it for the same phone in the first place) but now there are no other phones. Was merely wondering if I could do this idea, or be stuck with an awful phone for two years0 -
I'm sorry for the joke reply. I think you'll find that once you've opened the phone and stuck a sim card in, there's no company in this country that will let you cancel a contract.0

I think the main problem is the lack of research beforehand. Like any sales person, they will chat a lot of ..... to sell anything. (Not only sales tactics of phones4u you). Unlucky that you fell for it.
There are a lot of reviews saying that the N97 is not THAT good.
The only thing i can suggest is to sell the phone and buy a different one with the money left over. Looks like the N97 is selling for about £300 on that auction site. £300 can get you a decent alternative.
As a contract is a contract, you got to honour it i'm afraid

(Regards to returns of the handset, if you bought it in store. You dont get the 14 day distance selling cover.) Correct me if i am wrong

Well the guy I bought it from said 14 days, the Phones4u rep in London said 28 days and Vodafone said 7 days so I really wouldn't know.
I called up the store I purchased from and he said exchanging the handset isn't a problem, so I can (and probably will change) it's just the phone I wanted isn't out yet.
It's a minor, I understand it's my own fault was just checking if there was any legal way to worm my way out of it.

Your wrong there,i took my phone back to Phone4u within 14 days and canceled the contract,Just go in the store like i did and demand it,they dont like customers complaining esp when other customers are buying.0 -
