And I agree with your statement about a stores ability to correct mistakes btw.
The after sales service is just as important as the sales service.
I've no connection to John Lewis, but I'd recommend them to anyone, but perhaps not at sale time online.

Also, not advertising or anything but if you sign up to the partnership card, then you get a free £10 voucher i believe!

I feel we have moved away from the Real Grievance. A store taking money before despatch of goods. If you look at the T&C does it allow them to do this?

Hmm. Having an almost identical problem with Comet. Ordered a tv from their website on 27/12 and today Customer services rang to say that the televisions are out of stock - do I want a refund or to order an alternative? I asked for the next model up for the same money but they refused.
I spoke to my local trading standards office today and they say there is nothing to be done.
Is there anywhere else I can go for advice?
Unfortunately there is nothing you can do....Comet made and offer which you have ordered but Comet havent accepted yor order so they dont have to honour if they have no stock....mind you probably a blessing in disguise as I would never set foot in one of their shops again...all sales and absolutely appalling Cust Service if something goes wrong....bought a chest freezer from them last year and I am STILL waiting for compensation for damaged garage, wasted time...etc etc.....in fact i am STILL awaiting a proper response to my first letter and email (sent 8 and 16 since)....just in the process of reporting them to Trading Standards and contemplating small claims court action.Stevie Coppell's record breaking blue and white royal army - championship winners 2005-60 -

If you want to get away with it, you really shouldn't demonstrate the same grammatical errors with lower case "i" and no apostrophes in for example "im" and "dont".
Can't really see a partner of John Lewis advocating asking for reductions at the till or publicising an NHS discount code either.0 -

All hinges really on whether payment was taken or not.
Most purchasing transactions follow the following pattern -
1.supplier advertises or showcases goods for sale for a certain price
2. customer offers payment in exchange for goods
3. supplier accepts payment in exchange for goods
- or -
4. supplier declines payment and retains goods.
Once supplier has completed no. 3 then they have entered into a firm and binding contract to supply the goods specified. Until that point the supplier is under no obligation to supply.
If John Lewis/Argos/Any other Company has accepted the "offer to buy" by taking or accepting payment, then they have formed a contract to supply. Simple as.
Classic example and proof if it is needed is the Virgin backdown over the Gamecube.
Any claim of system failures is not a valid defence. If John Lewis (or A.N.Other!) breaches the contract then they are liable for the much mentioned "loss of bargain".
This is great and is exactly the point I am trying to make but, how do I make it when the staff I speak to just repeat parrot-fashion that they hadn't accepted the prder and we are only entitled to a refund?

Mamabear - below is the email (some Virgin specific detail removed) I sent to Virgin, I also sent it snailmail recorded to their Customer Service. Along with lots of other people, I'd been playing email tennis with them and they were insisting that they were very sorry they were unable to fulfil the CHARGED FOR order, but there was nothing they could do.
An important point was that their own Ts & Cs stated that the contract was formed when they took payment, you might want to check Comet's too. I emailed Trading Standards with the facts and their response was as I stated in the letter.
DSR also state that supplier's have (I think) 30 days to complete a contracted order, so in practise probably would have waited for that period before proceeding.

I write further to our recent emails and other correspondence in respect of cancelled ORDER ID *******.
I wish to inform you that I have sought further advice from Trading Standards on this matter. They have this morning confirmed beyond doubt that you are in breach of both your own Terms and Conditions and the Distance Selling Regulations.
Trading Standards have informed me that in order to resolve the matter, you have three alternatives.
· You can provide the goods as ordered
· You can provide an acceptable alternative
· You can negotiate compensation for “Loss of Bargain”
Please advise me within 7 days which of the above alternatives you wish to offer. In the absence of any such offer, I will have no alternative other than to purchase the goods elsewhere and initiate proceedings against you in the Small Claims Court.
May I strongly advise that you seek further legal advice in this matter.
