    No there isn't and I won an appeal on that basis. The CSA use receipt of CB by the PWC because it is easy. They can approach a school or college but the school doesn't have to answer their questions because of data protection.

    The problem is CB allows up to 20 weeks for a child to leave education and start again. This is inconsistent with CS laws.

    But surely there must be something the benefits agency investigating fraud can do ... otherwise there is no point in investigating child benefit fraud and everyone might as well claim their children are still in school until they are 19 as noone can find out the truth because of data protection.

    I think the Child Benefit people have the right to get info from the school, but the problem is they can't tell you the results because it isn't your business.

    How utterly ridiculous.

    But if you know for certain the PWC is committing benefit fraud, can you not take it higher if they are allowing them to get on with it? It seems daft because not only are they fraudulently claiming child benefit but child support as well.

    And if I remember rightly it isn't even a case of forgetting to tell the child benefit agency that your child has left school. Child benefit ends automatically and you get a letter from them. It up to the parent to contact them and tell them the child is continuing in education past 16/18.

    they have put the wrong closure date (later than it should be) and reason for closing - they have put that the "child" is no longer living with other parent, but the fact is the person we have been paying maintenance for is now 19!. And also the account is nil - even though we have overpaid. Its a joke, now I am trying to get it sorted they tell me their systems are broken and need to be fixed by a technical team.....

    anyone else been in this situation and what did you do?

    they have now sent an amended letter stating correct date and reason for closure, however, they still have system problems to change the date on the system.....I have been on the phone everyday this week, I now feel we won't get the refund we are owed...... what can we do now? also, my dh is worried that they will let pwc know that we are requesting a refund which could trigger an unwelcome visit, will they request the money back from her or just pay us back (if it all)

    They will request the money back from her.
  • hey sorry to butt in but a quick question-which parent is responsible to let the CSA know about the child leaving education:
    a) the parent who has the child full time
    b) the parent who is paying CSA

    (a) pwc, and it is recoverable by the csa if they don't report the change.
