    That's disgusting. It's not difficult to discover whether a child is in fact still attending school/college etc. Are you sure they have left?

    You should definitely be able to have the child benefit people chase it up as it's benefit fraud.

  • I've been in a similar situation, but the PWC did not deny my son left education. In fact the CSA told me to call the CBA and inform them to investigate. I had to appeal before they accepted that there is no link in law to Child Benefit. The other thing is that once a "child" reaches 18 they are proected by Data Protection - so the school will not give you any info.

    I agree that this stinks and is unfair when compared the powers that the CSA have with the NRP.

    But is there anything in the legislation (for CS1 & CS2) that says CSA is linked to payment of child benefit?
    SEPT 2008 - The CSA is responsible for collecting money in 553,800 out of 1,247,100 cases. In 442,000 of these cases the Resident Parent is on Benefits and so apart from £10 each, the money paid by each Non-Resident Parent goes to the Government and not the Resident Parent. The CSA collected £68.6m. Is the Govt. erasing child proverty? You decide!

    absolutely sure! - its farcical, we where then subjected to a re-assesment for the PWC to have her final squeeze of the cash cow. The only thing that makes me smile is that shortly lots of her income will dry up from both her NRP's, tax credits, cb etc.....

    The link to child benefit is only in relation to the fact that if it is in payment then they fulfil the criteria. A person who doesn't get child benefit should not necessarily be excluded from claiming child support - but if child benefit is in payment to a PWC then it will definately be allowed. What I am trying to say is that a person who doesn't get child benefit for a child, could still be a PWC, that is where the law comes in with the link. However, if a case is still live and child benefit is in payment, then the criteria for child support will be in force also as the criteria are the same, ie in non-advanced full-time education; if a pwc still gets child benefit for the child then the CSA will assume that they fulfil the criteria and therefore will remain in force.

    What did the child benefit people say when you made the claim? Did they actually investigate and let you know of the outcome?

    What's the point of reporting people for benefit fraud if it isn't followed up? :rolleyes:

    Is it the same penalty for a pwc to not report any changes i.e £1000?
