It should finish next week, but does it? I'm really confused now

Hi

CSA should cease from 6th September (child 19th birthday), I have been in contact with them to ensure that they case is closed on that date and that no overpayments are taken. I called this week to ask what progress had been made to a request for a breakdown of account that I made in January 2009 (still received nothing despite chasing almost weekly!!) and was told that the case may not close as there is another child in the "PWC" household. I am completely lost, this other child (18 years old) is nothing to do with this case. Does anyone know if this is true..... also why should I be waiting all this time for a breakdown, despite assurances that they would get something out to me I have now been told that a breakdown won't be done until the case is closed?!?!? I fear that this case won't be closed next week and we will be owed even more money. Any advice greatly appreciated.

I'm confused too, are you posting on behalf of your partner? Not sure about other's cases but I get an annual schedule, my SO is set to end on the last payment date before my child's 19th b/day (if it ends sooner so it be) . Anyway can you clarify as to which side of the fence you are posting, PWC NRp or NRPP?
  • Firstly, I don't know why you've had to wait for this long to receive the breakdown of your account. Probably due to the usual CSA incompetence. Also, you should not normally have to wait until your case is closed to receive said document.

Your best course of action may be to stop calling them & put all further correspondence, including data requests/complaints/requests for the case to be closed etc in writing, keeping copies of everything sent & received & use at least recorded delivery for everything to help stop the CSA from denying receiving anything.

What they have told you about the other 18 year old child being in the PWC's household is completely wrong. If this other child is not your financial responsibility, ie; you haven't been paying child support via the CSA for him/her, then this should have no bearing on your case whatsoever. You are correct in believing that all financial liability via the CSA for your child will end after his/her 19th birthday.

This again, is a problem with ringing the CSA. They can tell you anything on the phone, however inaccurate, & the onus is left on you to prove they've actually said it!

You've been misinformed. Unless the other child in the PWC household is yours too, then your case should be closed when your child is 19. An account breakdown can be done at any time.

Get back on the phone and ask to speak to somebody who actually knows what they are doing. A supervisor may be better - they won't action the case but you could ask for a name and reassurance that you will be called back with regular updates of what is being done. The biggest problem is that the action can't be done in advance of the change - the case can't be closed until your child is actually 19 IYSWIM, so really you need to call on or after that date.

thanks for all the replies, DUTR, I am nrpp but I deal with the CSA on behalf of my DH as he has been messed about by them for 16 years. I have authority with them to speak to and make requests. I can't understand why they are now making me wait for a breakdown. I know that the DOE has taken too much money last October so in effect we have been paying in advance, but how long will it take to reclaim the money from the other side, can I demand that it is returned within a set timeframe?
  • Hello jpmummy,

Even as PWC, it's not as straight forward as it should be ensuring that I am not overpaid when my son turn 19.

I have made numerous phone calls to request closure, and finally was advised to put the request in writing to have my case closed.
It should be so simple, 19th birthday, end. It's not a variable.

So it's not just NRP's having an issue with this.

  • So if a child reaches 16 and you think they may be out of full time education but the pwc won't tell you this information do you have to request a reassessment? Does the pwc have to be truthful and tell them that the child has left school?

We have had a battle for the last 3 years as we know that said "child" left education when they where 16, According to CSA as long as CB is paid you will still have to pay, they don't ask for further proof than that. CSA won't go after people who claim that their offspring are still in school when they aren't. Its disgusting.

Can you not report the PWC for fraudulently claiming child benefit?

As the CSA is linked to child benefit, they rely on the fact that if child benefit is in payment then they must fulfil the criteria for getting it, ie be in education. It isn't up to the CSA to investigate another benefit so if child benefit is in payment even if incorrectly then the CSA will remain in force. You would have to chase up the child benefit investigations to get this changed.
