    I don't know why people wont listen to me, i have been there, done that and got the responses, i know what Lloyds are like and the FOS but still people come here and go through the same stress that i had - to the point of making them ill. Until people deal with Lloyds i think they have no idea what we as customers are treated like.

    I honestly hope that this court case gets hurried up, until then i have no idea what to suggest to you, except take a bit of comfort that you are not the only ones that Lloyds do this to.

    Gosh Widelats, sounds like Lloyds REALLY got to you. I feel a sense of helplessness on her behalf actually. I've asked them to stop her charges and they have categorically said NO! Up to £25 per day with a 10 day ceiling. That's £250 on a tiny £1,500 overdraft! Surely that's legalised robbery? And just because they tell you they're going to do it makes it OK. She has her back against the wall and Lloyds know it. What a bank.

    So, should I pay it off in the hope of recouping it later or should I continue to fight on her behalf?

    What else is there Widelats? County Court puts stays on claims, people may be arguing the wrong case with the FOS ie refund me, I'm in hardship and here is the amount with paperwork. Some are not arguing that a lifestyle event cause income to go down leading to charges and the impact on the charges caused priority debts that are simply not being caught up with.

    Keep putting in claims is what you advise widelats. Remember, although the FOS may not agree with you they may well be noting how each bank is dealing with cases and even monitoring specific banks. We don't know because they cannot prejudice an investigation. Maybe Lloyds will have stern words said to them.

  • I have a Lloyds account and am in the middle of a hardship claim with the FOS for my current account charges and credit card charges. Having admitted to the bank recently that I am struggling with money (although this is temporary hopefully) their response has been to withdraw my overdraft facility of £5000 and start charging me £20 per day (up to £200 per month) as I am now in unauthorised overdraft. They did not tell me they were going to do it but claim they sent me 4 letters. (didn't recieve a single one)
    Fos are overwhelmed with hardship cases so it will take 3 months approx to get anything sorted through them. What to do? This has totally stressed my husband and I out and we have a toddler son to care for.
    My child tax credit went into the account before they withdrew the overdraft so can't access the money that goes towards our food budget. Local branch manager refused to speak to me about the child tax credit and said I was being unreasonable, shouted at me from the back of the counter whilst there was a queue of people behind me and made me cry in front of my little boy.
    There is very little help available, only the CCCS were able to advise me to freeze the bank account. Meanwhile the charges are snowballing....

    I used to think people moaning about their charges were just people trying to get away with not paying what they were supposed to. Now, via my mother-in-law, I see it completely differently. It simply beggars belief that financial institutions can apply such obscene charges to overdrafts, etc. There really should be a law against it. My dear MIL is ill with it all.

    My query now is, if I am able to, should I pay it off and hope they pay it back or should I let it get bigger and bigger and bigger to the point even I can't help?

    Fletch, theoretically I would do the latter however, when it is family involved I know that I would probably do the former because of the pain and hurt that I see in front of my eyes. It's a difficult one to way up.

    Make the FOS aware of the withdrawal of the overdraft because that is a material breach of the FSA Waiver.

    Unless this letter states it is their final response then no.
