llyods tsb hardship and fos

since may 09 i have been attempting to reclaim my charges from llyods tsb which were £872 but this month will increase to over £1000, they acknowledged in a letter sent in july that i was in hardship but would not process my claim because of the test cse being on hold. i contacted the fos whom in turn contacted llyods. this morning llyods sent me a letter again accepting im in hardship but stating again that they will not handle any claims until the test case is resolved! where do i go from here??? :confused:
i have two beautiful baby boys now :D

    What does their final response say?
    Do you have priority debt arrears(mortgage/rent, council tax, utilities)?
    Are any of the arrears being paid off?
    I have not worked for NatWest Bank since February 2009

    You are banging your head against a wall with this lot. They will refuse at every step to repay your charges even after admitting your hardship status. Hopefully the FOS will get a result, but I too am waiting since May and not heard anything yet.

  • Never overexpect of a financial institution because you will be disappointed. The difficulty of advising on here is, sometimes, someone gets a payout that is completely unexpected(from my perspective) and vice versa on others. Without seeing the I&E it is impossible to really tell if there is financial hardship, hardship or skintship so to speak.

    at present my expenditure( by llyods own calculations exceeds my income by £50 per month). had council tax arrears which the council are willing to spread over future payments and have gas/electric and phone arrears
    i have two beautiful baby boys now :D

    ive been trying to get my charges back from lloyds too for £5000+ i just keen getting 6 pages of waffle lol still no joy
    can i ask when do they think the test case will happen

    OFT test case is currently ongoing and we are nearing the 50% mark.

    With regards to how financial hardship works, if arrears are being paid off even by £1.00 then it can technically be taken off the hardship ticklist since arrears are being paid off. However, if nothing is being paid off and the arrears are getting worse then yes it is a strong case. after 56 days I would go to the ombudsman in spite of a lack of a final response letter and argue your case(not the bank said this or that or didn't respond).
    You write, lifetsyle event, for example loss of job,. caused less money into the account leaving payments bouncing leading to priority debt arrears(mortgage.rent, council tax, utilities) and that cycle continued and the charges made things even worse taking x amount out of my budget.

    If you are really unhappy or even think that the bank are breaching the FSA Waiver then complain to the FSA

    August 2008 to July 2009 there was 18 complaints to the FSA about breaches of the FSA Waiver. That figure is pathetic so do something about that figure ;)

    Hello everyone

    Hope you don't mind me butting in.

    My MIL has an overdraft with Lloyds. Due to charges, etc it's now over her authorised overdraft facility of £1,500. She's received a letter saying they're adding to it each day she's over her authorised amount. I did write and asked them to cease with the charges but they said not until OFT made their finding.

    My MIL has no means to pay this (and believe me charges represent most of the overdraft). I don't see any way round this but to either let it go up and up and up or take a loan and pay it myself.

    Does anyone have any other ideas I could consider.

    Open an a/c elsewhere and walk away from Lloyds. At the same time claim back all the charges since 27th July 2001. You won't get them back till after the OFT test case, but as the a/c is in dispute Lloyds won't either.

    Hi there, thanks for your response.

    I have opened another account for her and transferred her pension and direct debits but I haven't yet closed the account. One of the DD cancelled was a Lloyds loan but after a couple of months they took a payment out of it again. When I queried it they said it was not a direct debit but a "payment" and I should take it up with Lloyds loan area. I can't believe after cancelling a direct debit they allowed a payment out.

    I'm actually more scared to let it spiral out of so much control that even I can't help her. That bank has made her completely ill. She can't cope with anything now and she was a pretty self sufficient 70 year old before. Amazing what a faceless entity can do to a person
