Refusing to give back my car!

    Arrange a handover with him, give him the cheque, then ring the bank and cancel it.

    I wouldn't go wasting the police time -they have enough to be getting on with with real criminals

    I would go with the 'just take it back' option stated before, and send a letter to your ex saying you will send him hat is left of his £500 deposit after costs (his missed payments etc)

    Is the insurance in your name? Is so, advise him that you will be cancelling it from, say, midnight tonight, and that he will no longer have your consent to drive your car after that time.

    Driving a car uninsured and without the owner's consent is a serious crime.

    Any amount you may/may not owe him is another matter.

    If you have keys for it simply take it back.

    If not,simply state to the Police that you split up,the car is yours and he wont give it back and further,you do not give his consent to use it. They might arrange to attend at his address to ensure your unhindered collection of your property and whilst there,they may check his insurance.

    I could do with a new car. Will you buy me one?

    I don't really see why he should suffer the losses and you shouldn't when you agreed to take out the finance policy for him. I'd be reluctant to return the car as well when I'd paid £500 + payments and then have nothing to show for it. Reporting it to the police as stolen is really a step to far. To be honest if you sell the car on your likely to make a bigger loss than he will but at least you have a choice in the matter.

    Maybe it's worth seeing if he can settle the remaining balance of the car himself first, but judging by the fact he couldn't get credit and without knowing the value of the car it's unlikely this would be possible. Still, it's an option to put to him.

    Im really not sure how the police or even the courts would deal with this but if he could claim in some way that the car was a gift you'd be screwed.
  • Have you tried calling the finance company to see what usually happens?!?!:confused: I'm sure you're not the 1st and definitely won't be the last person this will happen to.

    Personally I wouldn't bother the police like previous posters have said they've got more serious crimes to deal with!

    If the finance company are no help then I'd go with the 'just take it back' approach.

    It's not stolen, don't embarrass yourself speaking to the police who will give you a boring "this is a civil matter" speech. He hasn't intended to permanently deprive you of your goods, you have after all discussed an amount to recompense him for the deposit.
    If you don't have a spare key that is a problem. Most nowadays, even if bought off of the dealer, need coded to the car and don't work straight off the shelf.
    Perhaps a better resolution is agreeing to sell and split the profit (there wont be any) and the deal and the relationship can slip into the past.

    The police would see it as a civil matter I think, however what was prev mentioned by Mrs Tine sums up what to do.

    I had this problem recently, but without the added complication of it being on finance. Police basically told me to go whistle, civil matter blah blah.

    One officer even told me that in the instance of me having a car, moving bf in with me and giving him use of the car means it is then jointly owned!!! This is ball-locks btw.

    I phoned RAC Legal helpline via Barclays who said i could either take him to court, or keep harrassing the police, escalating it to a complaint if they refused to act. I don't know if that was good advice though lol, i got my car back eventually, ex gave me it.

    I'm sure you have a much more solid case in getting your car back because it's on finance though so i don't know how that works. Definitely speak to finance people
