rent arrears

    her dad would pay off the arrears but then would nt be able to help her in paying rent and bond for somewhere else landlords told her is she leave he s happy for her to keep paying off the arrears each month without going to court so she wont get a ccj she does nt know wat to do for best pay off arrears and be homeless or lie to letting agent just so she can put a roof over her kids head s not sure wat hes on about putting it up to ill find out

    How did she get into arrears in the first place? Is the issue which got her into arrears now sorted out? If it's not, then what's to stop her getting into arrears in a new tenancy and repeated the process all over again?

    Well IMO she needs to be honest and up front a) because it's the right thing to do and b) because if she rents through an agency who does lots of checks on her, chances are she'll be caught out in her lie anyway.

    If she's in arrears with her last LL she'll obviously find it harder to rent if they require a reference off him and he mentions the rent arrears. Having said that, if she got in arrears with her rent, what else did she get into arrears with? Could well be that she'd fail a credit check anyway.

    Personally if I were her I'd rent privately again rather than go through an agency who are more likely to do thorough checks on her history.

    i am a LL. i had an application today from someone living with Friends and family. and with very poor information on his tenancy application form. Some of the documentation he sent to support his application showed an abbreviation of a Housing Association - who confirmed for me that he had left owing rent, that he is still paying off arrears. .... and i also found out in 10 mins that he had a CCJ for £1000

    he denied knowing anything about the HA when i asked him - he did not get the property

    i agree with earlier suggestions - pay off your arrears - then your LL will not easily be able to get you out

    honesty is always the best policy

    A voters roll check will easily confirm that your friend is telling porkies, IF the LA's are doing their job properly she should lose her referencing fee.

    Eeer, me? :p Unless things have changed landlords are limited in how much they can increase your rent by - as said if I remember correctly (IIRC) it's 5%. I mean with the same tenant in place.

    Twisted logic - the reason why her kids don't have a roof over their heads is because she didn't prioritise payment of the rent.

    A section 8 for possession is usually issued when a tenant owes 2 months rent which doesn't accrue overnight and is unlikely to be due to a modest increase in rent.

    If her arrears were beyond her control then she should be able to present herself as homeless at the local council who are obliged to help as long as she hasn't made herself intentionally homeless. This is defined as tenants not paying the rent when they were able (for example, squandering LHA without passing it onto the landlord).
