Misleading contract
Hi new here. My contract with 3 is several months old now but I'm curious about the contract I signed up for. On the site it has in big letters UNLIMITED TXTS. Yet I've realised now this is actually limited to 4000 txt per month. However are the mobile companies getting away with this? Sure if you have UNLIMITED on your advert, that's what you have to provide. I don't think then having in small print "fair use policy" should come in to it. If there is a fair use policy then it's not unlimited.
Is there anything that can be done about this?

No - the ASA say it's unlimited even if it has a FUP so theres not much you can do.Nothing I say represents any past, present or future employer.0

That's the same for Internet. I think advertising regulators were looking at it a while back not sure what they said though.0

Yes, i heard they were looking into it. i am eager to see the outcome0

There has to be a rough limit to stop people using a personal contract for spamming purposes. That said, it should be higher than 4000 perhaps 10000 which is equal to 330 texts a day.0

Surely 4000 texts a month is more than enough thats about 130 a day. Who texts that much?0

Is it not a case of that the contract is unlimited, however if you consistently go over their "fair usage" amount then they can limit you?0

Look on the bright side. If she was texting that much, it must have cut into her nagging time considerably.

Exactly. That's what I want to know. I can do about 2500 txts per month. Prefer txting to talking on the phone.
So I'd like to know what happens if I keep going over. Only usage page on 3 it clearly shows and counts down that I have 4000 txt per month but I paid for an unlimited service. Can they come back with "You should of read the fair usage policy". But can't you deem that as an unfair contract as it was clearly touted as unlimited txts.0 -
Plenty of broadband providers publicise an 'unlimited download' service, but it is still subject to a fair use policy in every case. I take your point in principle, but if you're never going to get to 4K texts a month then what does it matter? No free lunch, and no free laptop
