Sammy that is just appaulling. I would be tempted to go in person and ask to have a quiet word. If the money isn't given there and then I would go to the paper and name and shame! I have no idea who to go to to get them to cough up though..crapolaI'll make a wish, take a chance, make a change And breakaway. I'll take a risk, take a chance, make a change and breakaway ....

I have tried to encourage Nats to deal with this herself so far, but its getting too stressful for her now..she has been nothing but polite so far.
I can 'almost' sympathise with her boss...she is a small employer and so has to pay her SMP out of takings BUT she gets it all back from the Inland Revenue almost immediately. I have given her till Friday and then I will go down and hand in the letter that I have written. However, I might also be tempted to head butt her at the same time:rolleyes:.
Nats feels like she can't go back there after her maternity leave but to be honest I am glad, she was treated like crap anyway.....Quality is doing something right when no one is looking - Henry Ford

Does anyone know what she should do if the response is nothing......Its no good ringing ACAS - I know from bitter experience that they will say - her employer has a legal obligation to pay SMP but getting the money is a completely different matter. I have been paying her up till now!! but I can't afford to pay her any more and she needs to get some money from somewhere....
Small claims. Give them a deadline, then say you'll be taking them for costs too.Nats feels like she can't go back there after her maternity leave but to be honest I am glad, she was treated like crap anyway.....
Then take them for constructive dismissal. This is quite a powerful strike against them."Follow the money!" - Deepthroat (AKA William Mark Felt Sr - Associate Director of the FBI)

It is hard for small businesses but like you say she gets the money back! If she were running a good business then she would have put money aside for things like this and holiday cover! I'll come and do some head butting with youI'll make a wish, take a chance, make a change And breakaway. I'll take a risk, take a chance, make a change and breakaway ....

Do you mean a tribunal Z or small claims online...
I have also suggested constructive dismissal - hence my formal letter requesting confirmation of payments........Quality is doing something right when no one is looking - Henry Ford
