Fixture & fittings - vendor has changed their mind

Hello

The FTB saga continues....I received a letter from my solicitor today stating that 'the vendor has now decided against leaving the curtain-poles at the property and these will be expressly excluded from the sale'. Can they do this, amend the Fixtures and Fittings list after it has been signed and seen by myself?

I'm assuming that if they are taking the curtain-poles, that also means the curtains which were in the original F&F list. I've worked out there are 10 windows in the house so this will be quite a bit of extra cost! Also I'm having an operation just before the move so won't be up for doing any DIY such as buying and putting up curtain poles :sad: . Also I won't have the money!

Has anyone else been in this position? I'm going to ask my solicitor to query this as I don't want the hassle of moving in and having to replace the curtains etc. It worries me now about what else the vendor might take.

    That seems very petty.

    I once moved ito a house where there was 1 lightbulb and they'd even taken the sticks off that the curtain poles were on.

    You could respond by saying that, in the light of their revised F&F list, you are now revising your offer.

    No they cant amend a signed list, they have to draw up a fresh one that you both agree to and then sign. Therefore, as stated above, calculate the extra expense you will now face and tell them your offer is also being "amended"; you may get your curtain pole after all!

    You would have to ask your solicitor to confirm this, but ther curtains and fittings are part of the sale price agreed. perhaps you should renegotiate the sale price?

    Thanks for all the replies. Last time, after the survey listing the urgent work that needed to be carried out, I tried to negotiate a drop in price and the vendor wouldn't budge at all. In the end all I wanted was two things done; a drain fixed and a broken window replaced as the window would invalidate my house insurance from the moment the property became mine. The vendor wouldn't even pay for this work when it came to only £100. In the end the estate agent said they would pay for the work between exchange and completion, unheard of!

    I think I'll get my solicitor to say that I will only agree to the original F&F list as that is the agreed price of the property.

    I am now worried about moving into a completely stripped property :eek:

    ahh, I symphathise with you. Your vendors sound like right old meanies :mad:

    I'm selling too and I'm going out of my way to ensure that everything will be perfect for my buyers. I cant believe they wouldn't get those 2 little things fixed for you..... :confused: staggering isn't it....?

    Only re-iterating what the others have said. Get a new list drawn up and re-negotiate the price. Be strong and stand your ground otherwise they will continue to move the goal posts.

    I think the vendor has decided they are not going to budge, no matter what. I hate these goal posts being moved!! Wish I was buying your house ;) . On some threads I have read of home owners who left a 'Welcome to the house' card and bottle of wine, I can't imagine that happening!

    I think this time I'll ask my solicitor to be the strong one for me, but everytime he does these things it costs me money :sad: Everyone is right, I need to stand my ground!

    I have two things to cheer me up today; a freebies cuddly cow and Martin on the telly at 1630 :D .
