  • Yes. I have just found a web site that states unregulation on loans over £25K was abolished in 2006 or 2008 (don't quite understand the jargon) so since then the CCA applies to all loans. Doesn't seem fair. Do you think I can still argue my case from within the cca?

    I've tried to register on-line with Experian but they require me to send them bank statements, utility bills etc. through the post (which I will do if it's the only way forward).

    However, is there a way of checking my credit rating and/or defaults immediately without having to wait for the vagaries of snail-mail??

    You're best to send a statutory request (£2) to each of the 3 CRA's enclosing a copy of your passport/driving licence and a utility bill with your last 6 years of addresses.

    Can you be a lot more specific as to what is happening so we can help properly?

    Thanks for your help with everything - the CCA letters continue to be sent out.

    I'm not sure if this next issue should sit on this thread - if not perhaps you could re-direct me?

    I have just accessed my on-line Equifax credit report and have discovered I have 3 CCJ's registered:-

    Northampton CCBC date 07/07/2006 amount £11,226
    Northampton CCBC date 10/07/2006 amount £15,660
    Horsham date 14/02/2006 amount £1,855

    I knew nothing of these, and don't appear to have any records/documentation of these judgements. I'm not even sure what they are for.

    Obviously this discovery is pretty scary for me - what is my next course of action??:confused:

    Next question:-

    Having accessed my Equifax report I can now see which companies have registered a default against me.

    Previously I have sent them the 12+2 and the 30 day CCA letters. Whilst awaiting their replies should I send them the template "proof of default letter" - as I have no record of any of these defaults - or should I just wait the statutory 30 days and continue from there??:confused:

    can any of you guys confirm if these requirements below for the cca are correct and accurate? I just received a cca from Lloyds tsb, and it doesn't seem to be on one page, and it doesn't have the lenders signature either.
    I just want to check whether its unenforceable or not. any advice appreciated, thanks!

    I'm still making monthly payments to lloyds.
    How to tell if your agreement is enforceable?
    The agreement you receive (if they have one to send you) must contain ALL of the following:

    * It must be perfectly legible
    * It must contain signatures of both the creditor & the debtor
    * It must contain all prescribed terms including repayment schedule, interest rates e.t.c.
    * It must clearly state "Consumer credit agreement regulated by the consumer credit act 1974 (Not "Application Form" as many people receive, which is useless)
    * All the above must be contained on one side of one single document.
    * All other documents refered to in the agreement
