Hi
my story is long and complicanted but I am desporate for advice as I have no idea what to do. I am writing this blog from my hospitol bed in the hope some one can guide me in the right direction.
I have worked for a national recruitment firm for coming up to 4 years now and have always been a top performer. after 3 years of success within the branch the temps consultant left and a new one trancfered in from our leicester branch from the very first moment she started I know she wanted me out so should could gain promotion to branch manager. After She put in a complaint and threatened to leave unless somthing changed my director and regional manager had a meeting with me to tell me off and make sure nothing happened again. Apparently I created a bad atmosphere in the office?
I did what I was told and appologiesed and for the next couple of weeks thing settled down, again through she was getting heavly stressed due to not hitting her targets and blameing me for this. even though I was surpassing all of mine. At this piont anouth new position was being advertised within our business for a regional corpoarate account manager and I was told by all of the managers including the director that I should apply as it would be perfect for me.
So I did and I got the job and started in september 2008, I only covered 4 braches where as the other CAM's (as we call them) had well over 12 each to supply them with leads and opertunities so I was at a bit of a disadvantage from day one.
After three weeks on being in the role suprise suprise the temps consultant was promoted to branch manager! who happened to be very good friends with the regional manager and had worked directly under her for the past 2 years. At this piont I was very upset and under alot of pressure as the credit crunch was kicking in and due to my role being new alot was expected of me.
At the end of december I was rushed into hospitol with saver abdominal pain and spent 4 weeks in a hospitol bed, after major surgery I went home 2 weeks latter and was told to take a minimum of 2 months off but to not rush back this was the doctors advice, I was told that in there genorosity my company would pay me sick leave untill my sick note ran out.
After 7 weeks I phoned to see how work was going as I had had limited contact by anyone in the company. I was told that my sick pay ran out that day and I would need to use my holiday pay from there on in, I have a family to support and although in hind sight I should never have gone back to work as I was not ready I under knew that my job could be at risk if I dident. So I returned to work, i was asked to sit in a meeting with my managing director about my return.
I was told that it would not be a good idea to go back in to the CAM's role as I would be in a worse situation than I was in before under massive pressure and they cannot carry people in this economic climet, but there was the option for me to go and work as a perms consultant in the Milton Keynes Branch I live in Coalville and this is 70miles away but as I felt I had no chiose I had to agree. Since being there I work extremly hard and have been in the branch from 7.30am unil 5-6pm mon to fridat I have now turned the branch around so that it is showing a profit somthing that it has not done in over 2 years.
I was called into a meeting last week to be informed that my CAM role was being made redundant and I could either take statutory redundancy which was just over 1k or go back and work for the branch manager at Coalville complained about me (by the way since I left the coalville branch had taken a nose dive and was no longer making a profit so they had let go two of my replacments consultants since I was there)They also have told me I would need to take 6kpa pay cut and I would lose my benefits and company car. this last monday I was admitted to hospitol again for the same problem as earlier in the year and have again had to have major surgery to put right and I am going to be out of action for at least 2 months. I have told me manager and the second thing she told me was I would not be getting sick pay and they will take this up with me once I return. I am now in a position where I cannot work, I am not getting sick pay and I am suffering from stress and depresion due to not being able to support my family. I feel that the stress they have put me under for the last few months has seriously mentaly affected me and I wanted to knew what can I do have they acted unfairly / is there any support I can get apart from SSP fo next few months any help would be greatly recieved.

Why can't you carry on in the MK branch?0
-
they are taking the company car off me and will not pay for fuel to and from work so would cost me more than I earn, I am sure they are only doing it as they think I have built up the business they need me to go back to coalville to do the same again.0

Commuting 140 miles a day would cost you more than you earn? If that's the case, then they're probably doing you a favour.
Maybe think about trying to negotiate on the redundancy side?0 -
TBH don't think i would want to work for a company that had pushed me out of my original job, messed me about and didn't give 2 hoots about my health.
Is there no way you can negotiate redundancy (as said above) and find another job with another job as you seem to be very experienced and have a proven record?0 -
To clarify, you have been working at the Manager for Milton Keynes for at least 5 months? This was an alternative post to the CAM one that they asked you to relinquish? Was there any probation period placed on this? Were you told you would not be able to keep the car/claim petrol allowance etc?
It would also be useful to know what your medical situation is because you may well have a claim under DDA.0 -
Can someone clarify the issue regarding sick pay. As I recall companies claim stat sick pay back from the gov, so why would they not be paying you it?
Sounds like an awful company.0 -

Correct, Statutory (rather than Company) Sick Pay is reclaimed through the payments that the employer makes to HMRC; I forget now the thresholds where this kicks in but I used to calculate for a very small company and the SSP did not increase their outgoings, they simply paid less to the Gvnmnt to cover what went to the employee; the OP's organisation is much larger and so will be (if they have half a brain*) doing this routinely.
*(Which I'm not too sure they do have.)0 -
Could I recommend you contact your union if you have one (if not then can I recommend joining one
) or calling ACAS asap. I would say that if the situation is as you say then you may have a case for constructive dismissal...

My advice for what it's worth is this. You don't want to go back to the branch with the nasty manager, you can't go back to the MK one where you'd rather work. You think they want you back at the coalville branch to turn it around as it's now making a loss. Answer is simple really. If you are so good with the customers go into buisness yourself. if your relationship is as good as it seems i'm sure they'd jump ship and go with you if you setup your own venture. That way no long journey's to MK and no working with someone you don't like or respect.0
