How hard is it to get a job having misconduct against you?

    I got to the second page of this thread and felt the need to post this immediately as I was so disgusted at the posts from supposedly decent employers of major companies.

    Point 1: Woody, you made your sweeping generalisation re. misconduct before you knew it was gross misconduct. None of the previous posts stated gross misconduct and your reply stated just misconduct. You then went on to defend your stance citing gross misconduct.

    Point 2: Alongside the other posters offering support to your viewpoint, am I to take it that you hold full contempt for the Rehabilitation of Offenders Act that is designed to give people with far more serious "history" than someone with a misconduct charge, a second chance at life? Have you not heard of probation periods or perhaps recruiting someone with caveats of, "We will be watching you very closely."

    Far be it from me to tell you your job (which it seems I need to do) but you should be recruiting the best person for the role. Prejudging someone and categorically stating you will not recruit anyone with misconduct on their record is a complete disgrace and quite frankly should never have been posted in here.

    well said BA beers are on the way.

    what people cannot understand is that all i said too a worker colleuge was two swear words and i get done for gross misconduct.does this mean everybody on the planet gets the same.you look now on tv,all sports,films etc u will allways hear the f words and sometimes even more bad ones.

    yes i know i shouldnt have said it but there was provocation by the other party which i snapped and said i was sorry.

    well at the moment the local NHS are giving me a load of extra which i am grateful.

  • Good luck. I've been for jobs before with small companies where they don't ask for references, and others where they ask for 2 refs one current employer (would be NHS and maybe a personal (non work) ref. Don't be put off.

    That's one thing that sprung to mind last night, the NHS will now be your previous employer on applications you never need to mention that you were dismissed!

  • Well for what its worth I was dismissed under gross misconduct back in March, which I posted about in the past, which to be honest wasn't a dismissal offence but could be argued was a discipinary offence.

    When I spoke to a friend, who is a manager about it, he told me honestly that given two candidates of equal standing but one had a gross misconduct offence listed then he would probably go for the other candidate.

    I there and then decided to 'lose' this position off my CV and have explained the absence using a paulisable reason......I'm not proud of effectively lying but given the circumstances of my dismissal and the current economic climate I thought it was the best thing I could do. Only time will tell if this comes back to biite me on the behind but hopefully by then I will have proved that the reasons behind my dismissal were unjust.

  • well thyank's all for your advise,I am been done for swearing and behaving in an inappropriate way towards female staff,in short I was flirting and someone did not like it....so this come under Gross Misconduct think I'm In the S..T

    Hi there

    My oh was dismissed from work a few weeks ago due to gross negligence (a long story but something which is completely unfair and he is currently putting together his case to a tribunal)...anyway a week after he approached a business who were advertising a vacancy and before he applied he went and spoke to the manager and was pretty frank with them and explained the situation. His previous employer were refusing to give him a reference a bit tricky, however a week later he started there and they have given him a chance, it is less money but unfortunately I think most employers are scared off with Misconduct and I can understand why.
    So i guess what i'm trying to say is that there are some people out there willing to take a chance but honesty is the best policy and if you explain the situation without being detrimental towards your previous employer, keep to the facts, i'm sure you'll get something!!
