Car accident on mini roundabout

    The police didnt really say much, they made me fill out a form because me and the witness said they were speeding. Called them the morning after to see what their view was and they said that as no one was hurt it is up to the insurance to decide

    Mini roundabouts are usless witrhout speed bumps before it.

    If you are on the roundabout before anyone else then you have right of way.

    Giving way to traffic on the right , as per highway code , means those already on the roundabout and not the road approaching it.The reason for this is that you could be waintg for ages if your on a minor acess to a roundabout and traffic is heaviest from another part.

    However this is a pretty regular occurance at mini roundabouts , a clever driver should anticipate such given the road layout and selfish drivers will try to bang on through it at speed.

    The sooner council planners put in speed bumps approaching them the sooner it stops.
    Have you tried turning it off and on again?

    Well there was speed bumps on the road which i was approaching from, just none on the road which the other driver was hacking down. Just hope the insurance company take my side on this and say that they are at fault. Don't really want to dish out £560 for my excess!

    Highly unlikely, you could have cleared a mini roundabout in that time, however tight it was.

    I would guess that your only hope is that the insurance companies go 50/50.

    Well i have just been reading up on the rules about roundabouts, and if what i have read about those already on the roundabout having right of way (which i was) is true then hopefuly the insurance companies will be more inclined to put more blame on them, than me
  • I am told by people that work in insurance that accidents on roundabouts almost always end up being 50/50.

    A bit late to be looking up the rules, but they also clearly state that a driver should give way to vehicles from the right, which it appears that you did not.

    50/50 is my bet.

    Supposing the other car had been doing 30 mph, so not speeding, and a foot before he crossed the line, you pulled out over the line. There is no way he could stop in time and avoid hitting you, but the highway code says you have right of way?

    Surely most people (including OP since he though he had room to go before the car reached him) give way to traffic approaching from the right, not having crossed the line to the right.

    Just seems to be one of those times when the Highway Code wording is a little odd...

    You guys can probably settle an argument OH and I had the other day. I was coming round a large roundabout and had just started indicating left to exit at the next exit. I was positioned (in the correct lane) to come off the roundabout in the outside lane (you come off the roundabout straight onto dual carriageway).

    A car pulled onto the roundabout (there is one-way road onto it but not off, so I wasn't indicating left early as I couldn't come off there if you see what I mean) indicating left. He started turning into the left hand (inside) lane of this dual carriageway exit then changed his mind and moved towards the outside, which I was heading onto. A blast of my horn and he pulled back in and gave a sheepish wave but we came pretty close.

    OH said I would have been at fault for going into the back of him as that's always the way. I said no, because he pulled out, over a give way line, when he had already seen me coming round, and drove into my path and there wouldn't have been enough time for me to stop. Who wins? :)
