Money Moral Dilemma: Should Tash split the compensation cash?

    seems to me they're not that good friends in the first place if each is claiming the money against the other. in that case i'd suggest a serious review of the friendship and make decision based on that.

    if they were truly best buds, tasha would offer half the money and elena would refuse it, and perhaps they'd compromise on spending it on a trip to a spa or something.

    if it were me, i'd of course offer half the money back, but i'd secretly be a tiny bit gutted about it!!!!
  • I'm assuming that
    1. it was somewhat arbitrary that they used Natasha's card rather than Eleanor's.
    and
    2. Eleanor gave her half to Natasha soon after the bill was paid.

    They were therefore as close as practicable to equal contributors. They should morally be just as close in the settlement and should share the money.

    Notwithstanding, if Eleanor wants to retain a good friend to go on holiday with, then it is in her best interest to share the money.

  • As I see it legally when Natasha took Elena's money she became her agent, and as such entered into a contract between the two girls. In this situation how she paid for the flights is not material to the argument and Elena is entitled to a full refund. As agent this is a responsibility Natasha undertook. This puts the moral question on the other foot and it becomes "should Elena be magnanamous and only accept half?"
    Either way as I see it, a 50/50 split is the only way to go if you are "friends"

    I would say " You're taking the mick!! Section 75 only covers me but I will do the honourable thing and give you half the money".

    I have learnt something new here as I thought they would both be covered. I do a similar thing for a friend when we travel so I hope Virgin Atlantic isn't about to go into administration!!!!

    So what if it was Natasha's card. If she had any concerns in the first place, she shouldnt have booked her mates ticket. She's certainly not a very good friend if she isnt gonna share the losses.

    There's no question in my mind that if this was me, i'd split the refund. Mates are in it together, bad & good times.

    I would most likely split it 50:50; the sensible thing would have been - prior to booking - to agree the arrangement in the event of problems or anticipate the problem and organise insurance to cover unexpected events. The only time I would hestitate is if Elena was substantially better off than Natasha and Natasha was also a bit strapped for cash. In that case, I might expect Elena to waive her half. A gambling holiday in Las Vegas isn't necessarily an event for splashing the cash - a lot of people go there with hope (although not common sense given gambling odds!)
    Cheap and cheerful. Preferably free. :T LBM - more a gradual rude awakening.

    Split it and go together on a cheaper holiday. I'm sure it's more fun than going alone.
  • It all hinges upon whether Elena knew that her share was being put at risk by being sent on a non-family credit card. If she was made aware of this at the outset then she has suffered the consequences of choosing to pay in this way. Wasn't the whole aim of the holiday to take risks with their money ? Elena has gambled and lost, but maybe not as much as if she had actually got to Las Vegas.

  • They should definitely split it. If she had a explained before making the booking that if the company went bust she'd only get a refund for her own ticket then that would be a different story. I didn't know you couldn't get a full refund if it's not for a family member and I should think other people would also not realise. A friend is worth more than £150 and if my mate didn't even offer to give me half then she wouldn't be my friend anymore.
