Landlord problems

I have not heard from landlord in over a fortnight about repairs on the property.. anyways.. all the outstanding issues are still here..BUT I was asked about me paying the rent (I didn't move in for a good few days after tenancy commenced which Estate Agent is well aware of).. anyways.. Landlord has just been here shouting at me and being very insulting. I was told I had caused all of this damage myself.
I am really shaken and upset by this. They then took off in a mood.

Sorry to hear that - the landlord isn't supposed to just turn up unannounced unless he needs to do emergency repairs. What do you mean you were asked about the rent? Your having a right old time with this LL .
Before you moved in , did the LL or the EA make an inventory ? >0 -
I did an inventory and got it signed by the lad here who came to do a repair. It pointed out all the damage.
I had the estate agent around here pointing out damage to him, however, have since discovered a few health and safety issues.
My kids can't play in the garden because the fence has broken down the back, there is a huge rusty drum obviously been burning things in.. the soil stack is exposed and stinks, right outside the bedroom window...
There are tiles loose in the kitchen, on work surfaces and on floor. the house stinks STILL of dogs. There are no gas testing certificates to be given out, nor did I receive details of where my deposit went (it hasn't even been put in the right place yet, agent has it still.. hopefully a good thing)...
there are fag burns in the carpet upstairs , in the bath, there is damp downstairs, the double glazed units are all condensated.. the windows don't close, some don't open..
,.. the fridge is making my food off as it wont stay closed.. the garage is fillled with loads of junk.. there is garden waste everywhere..
The slugs are coming in all over the floors..
.. them shouting at me is the straw that broke the camels back.
I am NOT Paying their rent they can whistle. I told them I will move out as soon as possible.

If you dont pay the rent , as you are no doubt aware , you are in breach of your tennancy agreement . Have you taken any legal advice .
Clutton is a LL I think , ( so may give you some advice ) but let me do some searches for you . What is the EA doing about this , are the helping ?.... Are you recieving HB , if so the council could advise you also .

A legal team is dealing with it all now, tomorrow a letter will be send instructing him to carry out repairs to the property.
They will send in environmental specialists if necessary, request all safety certificates and basically make him comply with the Law.
I would advise all tenants in this situation who are struggling to contact the Legal team through Shelter as they really are serious about protecting people.
I am feeling better now anyways. She said don't witheld NEXT months rent, as two months rent means they can evict me... but said she can see why I never paid this month.
All correspondence (emails) is being used to back me up, I have been nagging about this for months.:cool:0 -

Prior to your post, I got the impression that CAB and Shelter tend to instruct tenants to meet their obligations in full while separately tackling the landlord for their shortcomings and always encourage the tenant to continue paying their rent. Sadly, some landlords will choose to serve notice on the tenant rather than attend to costly repairs.
If at the time of being served AND at the date of the court case, a tenant who pays on a monthly basis owes 2 months rent, a judge will always give possession to the landlord. Judges have no discretion whatsoever when 2 periods of rent are owed, they are mandatory grounds.
However, there's nothing to stop a landlord from seeking possession for discretionary grounds, such as late payment of rent, it's just a lot less likely for a judge to find in the landlord's favour for lesser circumstances than 2 months owed rent.
So I appreciate that your landlord is very poor and that you wish to leave but you still do yourself little favour in witholding rent.0
