  • Have just come back from holiday to a reply from my MEP;

    "Thank you for your email regarding the rules for discharged bankrupts.

    I will write to the Association of British Insurers (ABI) to raise your first point with them. This is a matter for insurance company policy, however I do agree that it can be unfair for those who are caught up for no fault of their own.

    Regarding the law on ‘lifelong’ bankruptcy stigma, while I appreciate your points on unifying our position with other EU countries, this is at present a reserved competency of the British government, and thus any change will have to come from the government here. I would recommend that you contact your local MP, who will be in a better position to comment on a matter of UK government policy, and influence any future legislation coming through Westminster."
  • That's an excellent reply, what about people sending reminders to MP's now?
  • maybe we should be lobbying the ABI too?

    Excellent idea, I've just written them an email saying how the clause is unfair in expecting people to declare this, say in the situation of a person becoming bankrupt in their 20's then meeting someone in their 40's and not even thinking about telling the other person they are bankrupt but with current rules this could invalidate insurance.

    Technically, if a person has suffered emotional turmoil at the time of bankruptcy, then this is all forgotten about, but insurers want to know years later, this could be a breach of the human rights act as degrading.

    Thinking about all this, particularly with the human rights act, I think I'm going to remind my MP again I'm still around and holding a permanent register of bankruptcy, or asking them to declare it to anyone for any reason after six years, could be degrading treatment and will they consider this in their lobbying.

    I had an email response from my local MP Nick Palmer who promised to seek advice and get back to me and I've recently had a letter from Lord Hunt of Wirral (If I remember rightly!!) saying he's going to find out more and get back to me, time will tell...

    Im waiting for Nick Palmer to get back to me, but in my experience he is ok, although a bit wet so im not holding my breath...but then we did fall out over his voting record :D

    Very promising. What I'd say with the time will tell thing, let's keep pestering them. I have kept a record of everyone who I have emailed and I aim to write to them every four weeks requesting progress updates. What do people think, is this a good idea and would you do the same?

    Hi all, I meant to come on earlier and let you know that a letter dropped through my door the other day in a House of Commons envelope! :eek:

    But it was my MP letting me know that she has written to Iain Pearson MP, Economic Secretary at HM Treasury about this matter. Will copy in one para as I thought she phrased her letter to him quite well.

    Ms ........ highlights three areas of particular concern with regard to those who have been made bankrupt. Firstly that individuals who have been made bankrupt face unreasonably excessive fees for insurance premiums. Secondly, that those who reside with individuals who have been made bankrupt, sometimes without their knowledge, are often penalised. Thirdly, she asks that bankrupts are not criminalised for life by having their details held on lists that are never erased.

    I would be grateful for a response to these points.

    and she copied me in on the letter! so will see if I get another letter from House of Commons shortly and update accordingly.
