It has been very kindly pointed out to me the Gazette has been challenged already and courts argue it is valid and must still stand.

City, which court? Because (with my hugely limited legal knowledge admittedly - but going on what other types of cases you hear about in the media and from something a legal friend said a bit back...) it would seem to be a European Human Right sort of thing - do we not have a human right to housing, and if BR this becomes very difficult, and if the record is kept on the Gazette forever then the ability to get housing remains unduly difficult forever as well.

Although I can well see it being a 'well, it's not impossible, and you don't have any right to live anywhere anyway' sort of thing as well.

Any millionaire BR's want to try and bring a case to the European Courts? :P

I've just written to my MP, with an amended version of wayforwards letter on page 2 (thanks, you made it that much easier!). Hate to think that once my OH is through his bankruptcy that it'll affect us or me with insurance especially since he'll be living with me. I pay the insurance, why the hell should i be penalised!?!
Don't let your fears stand in the way of your dreams. :A
  • It's gone a little quiet on this thread and I'm starting to feel people's interest may be waning - can anyone update me or perhaps add more bite to what I have already written to encourage participation please?

Hi City, I forgot, I had another recent letter just telling me that the matter had been forwarded onto Lord Mandelson as it was "his department" and I should expect another response, but if I haven't heard anything within a month, I will chase it up with my MP.

What ever happen to Martin's team looking into this? I don't think with rising unemployment this recession is bottoming out like they say. Bankrupcy seems to still be a dirty little word, I still don't see how records can be kept longer than 6 years, anyone tried contacting Clarisa Dickson Wright? She has been bankrupt 3 times technically and is a barrister. Surely, she might know something we might not?

Keep going something has got to change for us!

Ok, I've got a reply from my MP, who passed my letter on to the Minister For Business and Regulatory Reform, who basically said tough titties, the Government have done enough with the 2004 reform, the info will stay published in the Gazette because it always has, business have a right to choose who they deal with and where they gather information from. Oh and we should be grateful because BR used to be recorded on credit files for 15 years.

The Minister also wrote to the FSA before replying to my MP regarding insurance companies, FSA said it's not up to them to tell insurance companies who they should and shouldn't to business with, the insurance companies have a right to ask about BR before they decide to insure people.

This is a much abridged version of the 4 page reply, if anyone wants to read the whole thing PM me your email addy and I'll scan it for you.

that's not nice response at all Peachy, pretty shocking and disgusting actually, we really need to keep this going then, people power and all that and keep the pressure up because if everyone who is bankrupt, was bankrupt or is going bankrupt writes as well as their husbands/wives/partners, then that is a fairly large proportion of voters that the government cannot afford to alienate. I will post anything else that I hear.

That's not particularly nice of them! Right, who is up for a bit of reaction against ministers? Which minister has said this? I think we should ALL write to the said minister and tell them regardless of what has happened in a bankrupt's past, history is history and there should be a six year maximum limit which a bankruptcy can be taken into account for.

This would combat the problem of the Gazette - realistically, I don't think the Gazette is the problem, it's the fact the data can be used by businesses and this needs to change.

Peachy - can you tell us which minister who said this?

All - are you prepared to join me and write to this minister to make them aware of this very thread, and to remind them WE elect the Government, they have to carry out what WE dictate, and this response is not good enough?

Power in numbers people! Let's not take this laying down.

After that response, I would be up for it, we should bombard him with letters from everyone about it and just overload him with paperwork.
