How will I know if he is insured? No one got back to me yet really and I checked if he figures in the Motor Insurance Database and he does not, so my guess is he is not insured.it all depends if the guy is insured, If he is then you can claim your uninsured losses, If he is not then the MIB will probably take over the claim and the claim will be open for sometime.
Either way you will lose your ncd whilst the claim is open0 -
Just got a letter from DL I just don't get it. It says Even if the claim was none of my fault I may still loose the NCD and I will loose it for sure if They will have to pay and they will reinstate it only if they get the money from the other person... They are not insured!!! What happens then?

If they are able to track down the Third Party, and they are insured, Direct Line should be able to make a full recovery, from going what you have said about the incident.
If they track down the Third Party, and they are not insured, then by using the Uninsured Driver Promise, Direct Line will keep your No Claims Discount intact.
If they are unable to track down the Third Party, then Direct Line cannot prove that they are uninsured, and then your No Claims Discount will be affected using the normal step back scale.
Whilst Direct Line are making the investigations, you would normally have to pay your excess and the No Claims Discount is reduced. However, if one of the first two scenarios that I have mentioned do happen, your No Claims Discount will be reinstated.

Well I have just received a call from DirectLine and they admit that the claim is not my fault but at this time they have no information about other driver and their insurance even though I gave them the reg and my witnesses confirmed it.
At this time I am loosing two years off my NCD and have to pay excess. In my view it is just unfair if they admit it is not my fault but still snatch away my NCD it should not be like that.
I am thinking of applying for the owners details from DVLA myself as from what I can see DL and Police is taking a !!!! really.0 -

Why not? If you're making a claim you lose your bonus regardless of fault. It's not a no blame bonus.0 -

Well it is not my fault isn't it? Therefore I should not be penalised for it, this is how it works in other countries, but of course not in UK. This is not my fault that DL can't find the insurance details of the car that hit me... In my view it should be treated as being hit by an uninsured driver where DL promises to return all the costs incurred by me. The easiest way is to just don't give a f.... and expect the customer to pay for everything as they cant locate the car. COME ON! How hard can it be?!?!? DVLA gives the owner's details, find the owner and if it is a fleet car someone has to have the details.0 -

I had some guy go into the back of my car a while ago, he'd just bought the car from a private seller and wasn't insured. I was absolutely livid at the thought he'd get away with it so I chased the insurance company up frequently to chase him.
They said they couldn't do anything except write a threatening letter which they weren't going to do but I persuaded them. He then paid some of what they were asking and that was the best result for me, they then chased him for all of it and I got my money back.
I really hope you find out all the details you need - these people suck.0
