I'm not sure what one of those is, but I did receive a letter from them acknowledging financial hardship, if that's what you mean.
I sent copies of everything to the FSO with the completed form, pointing out that LTSB had acknowledged financial hardship but refused to discuss the charges.
Actually, they also said that their customer support unit would contact me by phone, which they haven't yet.
It isn;t a financial hardship closure letter which is where the FOS will have to get one from them and that will take time so you could be waiting for a response from them. A financial hardship closure letter should be sent with regards to accepting/rejecting financial hardship claims outling the reasoning behind why they have offered less than the full amount or no amount whatsoever. At the moment I suspect that they will claim that they have insufficient information.
Did you send I&E form plus notices of arrears?(just trying to jog my memory on this one)

I didn't send I&E details (but I think I will now, to LTSB and also FOS) but I did give details of rent arrears; I don't have a notification as, although I'm in arrears by 4 months, the landlord doesn't seem to have noticed yet! (I worried they will try to evict me if they do).

I just had another letter from LTSB - they have increased my overdraft facility to cover the excess, which means I won't get any charges. I'm not using that account anymore though, and I've cancelled all SO's and DD's on it.

So they have effectively complied with the FSA Waiver.

Even though they won't discuss the refund of charges I claimed for?

Under the FSA Waiver they don't have to refund charges:. By increasing the overdraft which therefore should mean that no charges are now being accrued they may just be crossing the line of FSA Waiver compliance, but as I said, it is only just.
Without formal confirmation in writing of arrears with the landlord, they don't have evidence of financial hardship with priority debt arrears.

Well I have no doubt that evidence of rent arrears will be arriving fairly soon!

That is when we can argue the case because we will have written evidence of arrears(which is what we need). That might change the outcome.

I feel I should point out also that although LTSB are increasing my agreed overdraft, they have only done this because there are charges due to come out of the account so they have increased the overdraft to cover these so I won't get charged for being overdrawn because of more charges.
Also, this agreement is only for 2 months.

We both know that you need confirmation of those rent arrears cos without it LTSB do not have enough proof of financial hardship in writing. Once you get that you can argue the point with LTSB, without it we cannot even argue the point to the FOS cos there isn't sufficient evidence on the table.

I had a call from my landlord's agent today.
They are sending me notice for being 3 months in arrears :$
I guess that counts as evidence of hardship??
Luckilly my landlord (HRH Prince Charles) is quite understanding and - this time - I will be able to make up the arrears, but in future? I don't know.
