This is the Scots Law defintion of extortion:- Extortion of money or something else of value from a person by the threat of exposing a criminal act or discreditable information. Or more technically "exploiting someone elses necessity".
You can find the defintion of harrassment in the Protection from Harrassment Act 1987.0 -

In my opinion that is nonsense, it would cost more in travel to get to the bank to make the payment, and how much would it cost the bank to handle the 39p deposit? How much did the bank spend on postage, envelopes, paper, and ink to send out letters with each charge and probably the cost of phone calls and staff time to chase it up and maybe even fees to debt collectors?
Has no one got any authority in a bank these days to apply some common sense and stop ridculous things like this happening. :money:or are they just drones doing what they are told.
Edit: i think the OP should send the new CEO of RBS by email, an environmentally friendly and cheap form of communication a copy of this thread and ask his opinion on the actions of the organisation he heads.0 -
Hello only joined this site today--and needed to talk to someone---I have been contacted by NATWEST collections agency to ask for payment on an account that I haven't used for 12 months--it was originally 39p overdrawn because of interest charges taken out by the bank themselves. Over the last 12months the charges have been building up but as I haven't used the account I did nothing about it. I explained all this to the very unhelpful woman who told me that unless I cleared this by paying £70 per month they would close my step account as well. As I have been working very hard to get back on track with my finances opening a new bank account would probably be impossible---I know that to afford £70 per month will take some doing. Is there anything I can do?
CAM1 let's reclaim the charges and I think I have advised you already to do so on the reclaims board.

I believe, extortion is a criminal offence anywhere in the UK and in most countries except places like Nigeria and Baku where it is a government led initiative. I thought you were joking? Do you really believe the PF would prosecute the bank in this case? As John Mcenroe would say "You cannot be serious"

I don't know, but she did seem intelligent enough to tell the OP to payback over £300 for a 39p deficit which if we include postage of statement, pre advice 2nd class on top(anyone know how much is 12 x 2nd class stamps? 1 phone call as well)
£5 perhaps? That figure may not include interest so we have 39p x 12 months at the unarranged borrowing amount as well.0 -
Why do people insist on taking the banks side on an issue that is just plainly, in my humble opinion, an abuse of their position in our society. Not least due to their own mismanagement of their customers money and that each household in the UK is proping them up to a 4 figure sum.
Out of curiosity is there anyone here, really, who would think that paying your bank 39p would be a matter of urgency and do you sincerely believe Natwest should have made any charges for an unauthorised overdraft of 39p (and please dont say, "well where do we draw the line") likely due to an oversight on the customers part.
Also I beleive the OP has two account one is a Step account, why did they just not take the 39p if they are that desparate. Unfortunately the answer is probably greed as it is better to keep charging the customer in the hope they pay up, than use as I have repeated on numerous occasions on this thread "any common sense".
Please ditch my idea of making a complaint to Natwest and the CEO, send it to the RT Hon Alistair Darling MP and let him bring the issue up at his next meeting with the CEO of the RBS Group.0
