Did I 'Choose' to include PPI?

Hello.

I'm considering trying to reclaim my PPI charges on my credit cards. I'm not certan but wonder if, when I completed the postal application forms, whether or not I ticked the 'cover for accident, illness' etc box(s), or, if I discussed the matter with their sales team as a specifically 'sold' aspect of the agreement which I agreed too at the time - which I think is unlikely I did.

Would this make a difference as to a successful claim or not? I've had cards for years and guess that I have built up a substantial amount of PPI payments over the years and of whihc a refund would be VERY useful.

Thanks in advance for any help.

    Hi and welcome.;)

It seems that PPI was automatically added over the years by many, but if you cannot recall on this there may also be other reasons that you can try to reclaim on for mis selling, for example:
The PPI may not be suitable for you, you may have had a medical condition at the time of when you taken it out, if this is the case it is unlikely you would make a successful claim.
    Or
You may already have been protected by your employer.
You may not have been working, or working less than 16 hours per week, so I would check on more info for this.

Here is the link to useful reclaiming information, templates and a mis selling checklist, if any of them occurs to you then write to them to reclaim on the PPI, plus the interest, they have 8 weeks to respond in full.
Keep at them until you either receive a response in you favour, or until you receive the final response where they should give you details of the financial ombudsman service (FOS), if your not satisfied with the outcome of your complaint you can go to the FOS for them to investigate.
Remember to post all letters by recorded delivery, as this would be your proof of posting.

Good luck and please ask for help when required and please also keep us posted, cheers.

    Thanks Di for yr response. I'll take a look at the link in a mo. A couple of things spring to mind in the meantime;

    A) How could I prove that my employer would have prtected me at the time? I have since altered my employment.

    B) Do I have to provide them with an estimate of the amount I am claiming + interest or will they do this for me?

I hate to think of how much I've paid over the years but it could be fairly substantial. Is there a limit as to how far they'll go back?

    Thanks

Basically they should take your word for it now, but when this was sold to you they should have asked you, so they would do their checks with your then employer, and if they did not then they did not follow the correct procedures of selling this to you.;)

    B) Do I have to provide them with an estimate of the amount I am claiming + interest or will they do this for me?
No you do not have to write any figures on the reclaiming letter, they should know to refund you with every penny you have paid in PPI, plus the interest, you then ask at a later date for a full written breakdown of calculations, they should actually supply this to you on an offer.

I hate to think of how much I've paid over the years but it could be fairly substantial. Is there a limit as to how far they'll go back?
I have been successful just previously with reclaiming on PPI going back as far as 2001, some have been successful even from earlier years. With PPI it is not like reclaiming bank charges as such, which is that of 6 years.

    Thanks

    Paul
Go for it Paul and keep at them, if they try fobbing you off on the first response then write back again.

Keep us posted so we can help you to the next step if required, good luck.;)

Di. Sorry about this - I am a bit confused.

After reviewing the template letters, I'm not certain which I need to use first.

I have downloaded all the letters and it would seem that I should be using either the 'Policy terms and conditions request' letter, the 'Stage one' letter or, the 'Request for paperwork' letter. The letters also seem to refer to the fact that I am asking for a copy of the loan insurance agreement and those that 'sold' it to me - but I'm not concerned about a loan as such - I am referring to my credit card(s), issued by MBNA (on behalf of MBNA themselves and Co-Op [now converted to Abbey]) and the PPI that I've been paying for years on these cards.

Am I correct in assuming that MBNA issued their own insurance, or, was it sold by MBNA, on behalf of another provider? Is this the copy agreement I should be asking for and if so, how do I find out who was the provider?

Sorry to be a bit of a twit on all this but I want to get this right with MBNA.

    Tks
    Paul

Hi Paul, not to worry, it can be rather confusing when you first start out.;)

In regards of what you need to do first will depend if you have any paperwork, in case you need to refer to this later on, for instance, if you no documentation you can start by requesting for the SAR (Subject Access Request), this is where they have 40 days to send everything as requested on the SAR, where there is a charge of £10 for this, payable by either postal order or cheque payment, template for your documents (SAR) is here:
    http://forums.moneysavingexpert.com/showthread.html?t=1475553
Not everyone will request for the SAR, but the information within the SAR maybe useful later on, if you have to take your complaint then for example the FOS, where they may require more evidence such as your paperwork to support your complaint.

However, if you just require the agreement for now that is fine, and will show the loan amount and any ppi etc, for just requesting this alone, there is a charge of £1 for this again payable by postal order or cheque payment, this one should arrive through the post by 12 days of requesting this....(True copy of your CCA).

As posted above if necessary, then you use template stage one for the reclaiming, however, you can just use the templates as a guide and use your own words if you want to, and of course write your own reasons.

I am not sure on MBNA, hopefully someone will post up who have had dealings with these.
However, it is the ones who sold you the finance you write to, no matter who the insurance is with.
So maybe in your case then you will write to MBNA.

SAR letter sent today to MBNA by registered post. I guess this is the first step (apart from asking advice on this forum - thanks Di :D) in this PPI reclaim bid. I'll do my utmost to keep the thread updated with all the twists and turns that are likely to be ahead. Wish me luck!
