As promised, here's the next update to my application to recover PPI from MBNA.
Having received my SAR two weeks ago, I immediately wrote baack to them with my application for refund letter - using one of brilliant the template letters.
I have just received a response from MBNA advising that they will now investigate my case and respond within 28 days.
Will keep you informed and my fingers crossed!0 -

Hi.
I had an interesting telephone call last week from MBNA.
They wished to discuss with me my recent correspondence with them about my PPI reclaim request. They advised me that they were taking this step of calling in order to try and speed up the process and calling was faster than writing letters. They asked me about why I though I had a claim against them and could I justify it. They also acknowledged that the whole matter was going back years and some aspects may well not be able to recalled correctly by me. I told them that yes, they may be correct in some aspects of not being able to recall matters but on this matter I had strong recollections. I advised that the sales consultant suggested that taking out PPC would aid my credit application and that the cover provided would benefit me and my family. They in turn advised that PPC was sold to their customers on a non-advisory basis and that it was added to the account at my request. They also advised that over the years the policy had been revised and that new Terms and conditions were sent out on each occasion and that on all occasions, I had 30 days of no cost options to cancel the policy.
Nevertheless, they also suggested that they would be prepared to offer a refund of 50% of all premiums paid as a gesture of goodwill. I have 8 weeks to respond.
Interestingly, at the end of the call, they also advised that the contents of the call may well be referred to and used by them in the future. I thought it odd that they only advised this at the end of the call as opposed to the begining of it. Is this in itself legal?
Finally, they have also written to me confirming the above - also enclosing a leaflet as to my further rights etc.
So....where do I go from here. Have other forum posters had similar experiences at all?

I read a post on here that said they got an offer from MBNA but asked for the full amount and got it.

Thanks for your update.
If your not comfortable by going through this by phone call, write to them as soon as you can by telling them you prefer to correspond with everything in writing, I would as well ask them for a copy of all telephone recordings, and of course if your not happy with the offer, you can take to the FOS, if you don't mind waiting a while by going through them.;)
You could give it another go, by telling them (if you want to) that your not happy with half of the offer and ask them to reconsider the full amount, or even suggest they offer more than half.

MBNA have very recently lost a county court case because they didn't disclose that they had receivied a commission from the underwriters of the PPI.. The Deputy District Judge found that:
"an unfair relationship had arisen within Section 140A of the Consumer Credit Act 1974 in the light of the standard advice to the Defendant to the customer to take out PPI when combined with the receipt by the Claimant of undisclosed commission. The appropriate order pursuant to Section 140B of the Consumer Credit Act 1974 " and ordered the return of the PPI Premiums (plus interest).
You could add that on to your own complaint if it applies I guess:AIgnorance can be cured, but stupid is forever!:A

Hi all. Just back from half term holidays and am still a bit confused as to what to do.
To recap, I've received a written offer for 50% of the premiums paid as 'a gesture of goodwill'. The letter also refers...'Please be advised that PPC is sold to or customers on a non-advisory basis and was added to your acct upon your request during the application stage of your credit card account.'
I suppose that that may well have been the case..however, even if it was on a non advisory basis, they did still sell it to me without checking if it was suitable. I'm now left with a choice of either accepting their current offer or, renegotiation with them, or taking it to the FOS.
If I take it to the FOS, how long does it take? I could just call them back and see if they will renegotiate I suppose. Anyone got any previous on this?
So sorry to bog you all down with this...I'm just looking to get the best settlement I can and suppose that someone out there has been in a similar position to me.

You do have a point here, but its entirely up to you, if your not happy with the offer then as you know you can either ask if they can reconsider the amount, this does not always work, or of course take it to the FOS.
It can take some time unfortunately, the longest of that possibly just waiting for it to be passed on to the Adjudicator, unless a resolution happens before it goes this far - sometimes this can also happen.
It is a chance you take really, but after its passed on to an adjudicator the norm is approx 6-8 weeks, if straight forward, otherwise some can take as long as a year or longer, this will also depend if the bank does agree or not and if the adjudicator passes this on to the ombudsman himself.
However, I note from a post or 2 the other day that they were not waiting that long.
So either way, its your choice now hun, and wishing you luck with this.:beer:
