I have got a cashback contract with the above company. Although I sent my correct bills at the correct time but they will not pay as I did not send them recorded delivery. Has any one tried to claim through the small claims court and if so have you been successful?

Unless you proof of delivery I doubt your claim will be successful. Might be best to cut your losses.

That isn't the "reason" they won't pay. There are hundreds of pages on E2Save and Onstopphonshop which will answer all your questions over the last two YEARS if you look for them on here. You have made many fatal errors from day one; a) no research beforehand - or since obviously. b) not sending recorded delivery. c) not resending within the claim window when it wasn't received. You have probably also missed d) understanding the t&c beforehand - and may therefore also have claimed on the wrong dates. Not sending rc is not a reason for denying a claim. Non-delivery and a few other things are.0

if you've missed the window to send in the respective claim and you dont have proof of delivery then there is probably little you can do if they say they didn't receive it. they could turn around and say that you forgot and only just remembered and have tried to cover yourself by saying you did post it...not the case, i know but unfortunately it's the oldest excuse for them to get out of paying0 -
They don't and wouldn't say anything - except that they didn't receive it. They don't and have no requirement to explain why it was or was not sent. If it's harsh it's because I've spent the last two years on these threads warning about this company and assisting many others to obtain their money - but don't have much sympathy for those who don't actually check before asking for the same answers a thousand times from the same people who have spent so much of their own time assisting.0

who asked for sympathy? a little respect wouldn't go amiss. you're not the moral guardian of mobile phone cashbacks. the op may have made one simple mistake, yet you go off on one...cliaming the moral high ground as if you have written the gospel according to mobilejunkie on how to get your cashback and how dare anyone not follow it.....if they make a mistake after not following your guideline...then to hell and damnation with them!!!
yes you have been helpful but not everyone has your experience, not to mention time, to be as thorough and prepared as you. how the heck do you know why the OP hasn't taken the advice of you and others? do you know what goes on in her life? maybe she never had a phone before! maybe she never knew about Money saving expert before! perhaps she is only 18!
it's beginning to wear thin- your constant venom towards e2save and equally noticed is your constant flag waving of phones4u...the latter has been equally dreadful at handling claims, not just for myself but many others too.

I understand MobileJunkie's frustration. The CPW group seem to be, from all accounts, continuing with sharp business practices - others might claim dishonesty - and new members keep coming on the site with repetitious posts on the same subjects, covered innumerable times over the years.
By the same token, it is fairly clear that the first time any newbies use this forum is when they have been stung - no doubt being referred by a friend who probably says "You should try the MSE forum - there is something about that company on there".
So, it's not a question of people ignoring MobileJunkie's advice - it's simply that they haven't had cause to see it before. And don't overlook the fact that over his many posts, there is a great deal of excellent advice there.
It might be helpful and less contentious if MobileJunkie included a link to a relevant previous post in his replies where appropriate as new posters are facing a financial loss and do want some help.
I think that most people who see a big name like CPW or perpetual advertisers like E2Save or Onestopphoneshop and haven't dealt with them before probably believe that they are honorable firms who will treat their customers fairly and above board. It comes as a shock to them that they are dealing with aggressive hard-headed businesses whose business models appear to depend upon a high failure rate of claimants. When they find out, then that is why they turn to MSE forum for help.
Equally, there are many purchasers who do not read the small print and get caught by the t&c due to their own lack of due diligence.
So, to get back to the OP's initial question - "Has any one tried to claim through the small claims court and if so have you been successful". Any successful members willing to help and give advice or even links?0 -
Thommy:- Yes, we do. But my time is just as limited as anyone else's (although you obviously believe otherwise simply because I have devoted so much of it on here for so long) and (believe it or not) once I had never had a mobile contract before that alone a cashback scheme. No-one HAS to jump in without research - or ask the same old questions without bothering to look up the answers already given hundreds of times. Obviously, my time is less valuable than anyone else's!
As for E2Save and Phones4u; I have far more experience of both than most people on here as far as cashback contracts and the contrast in their dealings with customers (and I look after the multiple contracts for several other people as well) couldn't be more stark. How many people have had problems on the Mobiles2yourdoor thread - and how many on the dozens of E2Save and Onestopphoneshop threads? It's nice that someone reckons I only praise phones4u though - previously my critics reckon I only give negative feedback. Looks like they want it both ways now!

Guy's Dad:- Yes, they have - no doubt hundreds of them (dozens on here). There are many threads on this and they take some time reading through. Also E2Save recently changed their tactics - people now suing really need to be able to prove their case and determined to see it through. Two of the people I look after sued with my guidance and won - without going to court in the end. For those you can't figure out HOW to search; in the top right hand corner of the screen, click the arrow next to search and select "forums"; then type in the key word (e.g. E2Save") and scroll down all the latest thread entries selecting any releavant threads. Just about all the answers to most questions are already on here - which is why I spent a year reading BEFORE buying and never joined to ask a question.0 -
