Dealing with Bailiffs Harassment

  • I live in a flat in a converted shop. There are three flats, each registered as seperate properties, with one external door with a buzzer/intercom to each flat, and each flat has its own lockable door inside, one flat on each floor. Should I refuse entrance to a Bailiff ie s/he gets me on the intercom and I don't let them in, but s/he then buzzess one of the other flats and they do let him into the building, will s/he have the right to forcibly enter my flat? Also I have heard that Bailiff's have been known to use rather underhanded tactics to gain entrance...I often use the intercom to allow guests of other flats in if the other flats happen to have their intercoms turned off, or if the electric meter reader comes I will just press the buzzer to let them in (after all my flat door is locked and there is nothing in the passageway they can steal!). If a Bailif were to mislead me about who they are, although I doubt the legality of that, or somehow otherwise got me to let them into the building's communal hallway but not my own private flat, would that count as a peaceful entry and give them the right to enter my flat? I know it may sound silly, but it just came to mind when I saw a post earlier about external and internal porch doors etc so I just wanted some clarification about what that meant for people in my situation :) Cheers Bex

    The shared areas of the flats are just that, a communal area, not your property. Your flat door is the boundary between your property and the outside world, not the gate to the communal area.

    As for letting in any old person who leans on the buzzer - never mind bailiffs, what about burglars? It's a risk you have to consider I suppose.

  • Help I'm trying to access bailiffadviceonline to get the letters for Council Tax & income support but the Nochex payment page is coming up as unsecure in Chrome, so I'm wary of putting my card number in.

    Tried pm'ing Herbie21 but his pm box is full.

  • Hi. First time here, sorry if this is the wrong place to post.

    Bailiffs have been round before for my girlfriend who owed £200 on council tax for a previous property. She let them in and signed an agreement as she wanted to pay.

    I have now got a letter from them about a different council tax debt, that I wasn't aware of, and they say they are coming to remove my goods tomorrow (22/6/12).

    As they've been let into the property before, although for a different debt, I'm concerned that they can now break in to remove goods and the letter, although not specifically saying that is what they will do, does imply it.

    Can anyone offer any advice? I'm particularly worried because it doesn't give me any time to sort it out.

    I remember a case some years ago where bailiffs seized a motor vehicle and the owner used his remote vehicle key to lock the doors and immobilise the car and then shot dead the bailiffs from outside.

    However I can't find any reference to this on the internet though I think it was in Bristol somewhere.... perhaps someone here knows more details?

    Now it has been said that if a bailiff got in through an unlocked door you could take it as a burglary and taking steps to protect your property by using necessary force sadly and regretably fatally wound the bailiff.

    What happens in this instance?

    You'd go to prison for a long time.
