This is a bit of a stupid question, but we are getting threatening baliffs letters in the door saying they have called by to collect goods to repay debts owed by previous tenants(obviously they dont know that those tenants are no longer living in the property). We have been in the house since September 2009 on a new lease and have been on the council register since December. We don't need to worry about the baliff trying to take anything right?

The previous tenants have nothing to do with us, they were simply the tenants in the house before we moved in. From the amount of late bills and final warnings they are getting, Im guessing they scarpered to another country (they all have Arabic names).

I left a voicemail with the baliff today anyway just to stop them bugging us with letters.

The difference here, being it is not you - just let them in, be polite and show them ID etc to prove to them. Pointless being nasty cos you're innocent so if they cause you pain or suffering you can have them up in court.

You're safe, just be normal with them and assist any way you can, even if you know where the old tenants are don't get involved by grassing on them just refer them to the landlord who will corraborate everything with you and will also have proof of when you moved in.

Don't worry, that's for sure :D

Hi,

Bailiffs are claiming that they have levied my car. They filled in inventory of goods seized sheet and put it through my letter box. Obviously the car was on the drive so they got details. But they don't have my signatre on the inventory sheet so is this a levy or attempt levy? I am fighting over excess fees and this is important as they claim that levy has been made and the charges are lawful. Thank you!

As far as i am aware so long as the levy is valid, (car not used for work, and you own it) The levy is valid and can be charged, the advice is when bailiffs are threatened move the car onto a different road.

Dear Sirs,

Ref Account No: .............. Child Maintenance Arrears

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.
Furthermore I realise that the debt outstanding of (£676.43) needs to be paid. If you have checked the case you will understand that I have paid the C.S.A. for the last 15 years without fail. However as stated in Court I am currently on benefits, so am unable to settle the full amount in one payment. I am willing to offer a sum of £50pm. I believe this to be a reasonable due to my current financial situation.

Yours faithfully

I have a quick question about bailiffs fees......

Am still trying to sort out what I owe the council, there are long winded things like unapplied benefits which are taking forever to sort out but anyway...........
Equitas are not letting up even though they know what's going on (council have contacted them and so have I) so I have just been ignoring them for the time being until I know exactly what I have to pay. I have never been home when the bailiff called and he has certainly never entered the premises while I was out (doors are all locked and my dogs would not allow it, he would be mad to try) so why has he hand written on my last letter 1000 IE when the maximum outstanding before everything is sorted out is 750??

Has he levied on anything? Has a list of your goods been put through your door?

Nope, haven't had anything like that from them. Also I would have thought there is nothing to levy on as they haven't been in and my car is away from the house.

Well that's pretty easy then.

Council tax, no levy, max fee is 2 visits "with the intention to levy, but where no levy is made". Total of £42.50.

They can visit more than twice to attempt a levy, but they can only charge for 2 failed attempts. Anything more than that and they're charging incorrect fees and should be the subject of a formal complaint to the council, because the council are responsible for their actions as agents of the council.
