Help plse

April 09 I ypgraded to the new sony erikson C905 handset on an 18m contract.

In the 1st 12 weeks of having this phone it has spent 6 weeks being repaired for problems with the speaker to software issues..

I got the handset back on wednesday this week after another 2 weeks of the phone being away and within 24 hrs the phone has yet another software problem.

T mobile have said that i need to send the phone for repair again..
I said i want a new handset as the one i have is clearly no good, and has gone for repair 3 times within 3 months with it now having to go away again. They claim to not have a replacement policy and said if i have a problem i should take it up witht the manufacturer.. surely my contract is with t mobile not the manufacturer.

How many times do i have to send the phone off for repair before the phone should be replaced....Do i have grounds to demand a replacement.

Also whilst the phone is off being repaired i have to use an old inferior handset from the t mobile to use whilst my supposedley expensive all singing and dancing phone is being fixed. This lone phone does not have the same functions and facilities as the phone i am paying for has so surely i must be due some form of rebate too..

Can any one help with this

    How about asking them if they are aware of the sale of goods act and how you go about making a complaint.

    I like the bit that said

    "If a consumer chooses to request a repair or replacement, then for the first six months after purchase it will be for the retailer to prove the goods did conform to contract (e.g. were not inherently faulty)".

    i had a problem with my n95 with the same problem and i was told that the handset has to be repaired 3 times before they will replace it....iv been told that over the phone and in store....i have the se w995 and it went strange within a week so i had it replaced and it started on the new one so i did a software update and its been fine since.
    keep fighting huni.
