"Happy birthday, here's a present", is a far cry from "oh, I'll just help myself to a season ticket on your credit card without your permission".
Hopefully he won't have the audacity to mention presents bought for you if it does go to small claims, but he might, and they might take them into account unfortunately. They might also question why you didn't recall his season ticket at the time he put it on your card; so it might not look too good for youYou can but try though.
It's not like I didn't buy him presents aswell though, so I really don't see why that should come into it.
Also, with the season ticket thing, I dont think i've got a valid claim with him using my card without permission, but the debts still there to be paid by him. I didn't raise the issue at the time as we were still together and he said he would pay me back, which he hasn't.

I did send him a letter which he recieved a couple of weeks ago. I've not heard anything from him, and my brothers tried to reason with him.
He still doesn't seem interested so I think im going to raise the claim.
Whats the worst that could happen?

I admire the fact you are standing up for yourself but I fear the chances of succeeding are slim.
Firstly he'll probably claim that he had your permission and if he's half a brain cell say that you bought it as a gift. There's no proof otherwise.
Secondly even if court did find in your favour, he's no job so is unlikely to be paying you back at any suitable rate.
Finally the cost of chasing the debt is probably not worth it.
Its a nightmare and one you may end up chalking up to experience. Its times like this where sometimes its good to know some "handy" blokes.0 -
Could you try calling the credit card company and and asking if they have any notes on file or (as a very long shot) phone call records relating to him charging this season ticket? Explain the situation and they might be able to send you something?
