"Saxby was jailed for 12 months, disqualified from driving for four years and ordered to take an extended driving test after that."

I think there extenuating are circumstances in your case (at night, on a motorway, competent riding). And this chap was also doing 60mph in a 30 limit and overtaking on blind hills which won't have helped.

    Hope that helps!!!

Get out of it? The suggestion to go to pepipoo was for some practical advice, not to "get out of it". Because practical advice is usually thin on the ground on MSE in situations such as this.

You could be forgiven that when you posted originally, but i'd say the vast majority of posts so far have been offering practical advice.

Eeek, like a large proportion of drivers I used to regularly do 75/80 in the motorway but with age Ive slowed down to 65/70. The reality is at even 90/100 you would be screwed if you lost control, 130 on the other hand would be horrific.

At least hes alive and well.

like most on here i would say 12 month ban, 6 points and a huge fine.

There's simply NO EXCUSE for driving at those speeds.

Hi, whilst i cannot nor wish to predict what you will get i will share my experience. Of course i in no way condone the speeds we bikers can and do travel at...in my view i got caught and was prepared to take the punishement.

Caught at 101mph in a 60 mph on a bike (nice country road Sunday afternoon, conditions dry). Went to court, no option of points (obviously). Everyone said it would be a ban, over 100 mph etc etc. No solicitor or excuses, dressed smartly offered my apologies and showed remorse.

    Outcome ?

6 points, 250 pounds fine. So a ban is NOT automatic over 100mph, the magistrate even said they had never considered it in my case.

    Good luck.

if it is just over 100mph they can and do let people off with points and a fine. But 130mph? That is nearly DOUBLE the speed limit on a motorway!

A Royal Navy sailor only got a 56 day ban with £175 fine and £35 costs for speeding at 155.5mph on the A3(M) at Horndean when he was sentenced in 2005 for an offence in 2004. He even managed to plead guilty by post and serve out most of the ban on board his ship at sea.

    See http://news.bbc.co.uk/1/hi/england/hampshire/4605999.stm

Same judge as in my own speeding case a few months ago but I was only going a much lower amount over the limit and I was only in court in the first place because I didn't take the fixed penalty and challenged the Police's evidence.

In any case it clearly shows that it very much depends who you get judge or magistrate wise. Some of them can clearly envisage driving at the same speed themselves (at least in their youth) but some others regard it as a near hanging offence and they have a lot of sentencing latitude at these higher speeds. It also does depends on the conditions on the road and if there was any intimidation towards other drivers etc, etc.

Some of the info given in this thread has been wrong as the maximum one off ban for just speeding is normally 56 days unless you are also charged with Dangerous Driving. A 6 month ban only happens due to totting up to 12 points. And a short ban does not clear your licence of all other points. Only a 6 month totting up ban for getting to 12 points does that.

Dangerous Driving is an automatic 12 month minimum ban, extended retest and you can even get community service or a time in prison for it in the worst cases. Due to a general hardening of the line some CPS areas are now trying to bring Dangerous Driving charges for driving above 120mph or 130mph but convictions from this offence are far from always guaranteed unless there is a lot of other bad driving and/or bad weather conditions etc also involved. Those who reported being banned for 12 months were clearly also done for Dangerous Driving as well as the speeding offence.

And much more accurate information is definitely offered over at www.pepipoo.com than here on this forum on this particular subject.

Can I assume this still hasn't been to court yet as they have up to 6 months to issue a summons and the trial may not happen till several months after that. If the OP has a young child and him losing his licence would cause loss of his job and exceptional hardship to his partner and their newborn this can be put forward as reasons why only a shorter ban etc should be considered. I think getting 6 points instead of a ban of a few weeks has to be out of the question though at this speed,
